Delaware law on the application to an authorized judge for the intercept of wire communications was written prior to the creation of the statutory divisions of Family, Fraud and Consumer Protection, and Civil Rights and Public Trust, within the Delaware Department of Justice. This would allow for the divisions leading, for example, sensitive fraud, public corruption, white collar, civil rights and hate crimes investigations to apply to the Superior Court for wire intercepts, and further makes clear that such investigations fall within the purview of the electronic surveillance chapter. Human trafficking is already included in the statute, but its investigations and prosecutions now fall under the jurisdiction of the Family Division.

The State of Delaware previously offered an employer match for state employee contributions to the deferred compensation program. The purpose of the match was to help state employees save and build wealth for retirement and to enable state government to recruit and retain talent by offering a valuable retirement savings benefit. In July 2008, during the Great Recession, the State suspended the employer match to cut costs. Every year since fiscal year 2008, the General Assembly has written in the annual appropriations bill: It is the intent of the General Assembly that this program be reinstated when funding becomes available.

This Act adds clarity to the statutory changes made by Senate Substitute 1 for Senate Bill 151 of the 151st General Assembly related to drivers licenses for foster children. This Act clarifies that during the initial 6 months of a Learners Permit, a foster parent is liable for the negligent driving of the foster child up to the limits of the foster parent's applicable insurance coverage. This Substitute differs from the original bill in that it clarifies the language that refers to the insurance coverage and clarifies such language in both the new subsection and in the existing Code.

In 1995, the General Assembly directed the Code Revisors to gender neutralize or otherwise ensure that a solely masculine or feminine designation never occurs unless it could only apply to one gender. The Code Revisors followed this direction and worked to ensure that laws enacted after 1995 were gender neutralized during the codification process. The Code Revisors also began working through the Delaware Code in existence in 1995 to gender neutralize existing law, a process that is not yet complete.
