This Act amends the Charter of The Town of Milton. Specifically, Section 1 of the Act allows for an exception to the lengthy annexation process for a contiguous property owner seeking annexation if the property is two acres or less. Section 2 of the Act then sets up that less cumbersome annexation process for properties two acres or less. Section 3 of the Act replaces the list of exceptions to competitive bidding with incorporation by reference of the more detailed Town of Milton Procurement Policy. Section 4 of the Act reinstates a prior limit on real property taxes to a function of the total of assessed values within the Town. Specifically, the cap is 0.5% of that total. Currently, the cap is a fixed number, $1,750,000. However, the Town has annexed into its limits a number of parcels that will necessarily require additional expenditures of Town funds for services such as policing and, therefore, the Town will need to collect additional real property taxes.

This Act prohibits rental companies, shared vehicle owners, and peer-to-peer car sharing programs from recovering damages and charging administrative fees relating to the loss of use of a rental vehicle or shared vehicle. This Act abrogates the common law of loss of use to the extent that it applies to shared vehicle owners, peer-to-peer car sharing programs, and rental car companies and supersedes any other statute to the extent of a conflict.

This Act clarifies the process of obtaining a Nursery Inspection Certificate through the Nursery Industry License Application (NILA), which is now available online. This Act also cleans up and updates language used in relation to Nurseries and Nursery Stock. This Act provides for the proceeds of any fines or penalties imposed for violations under Chapter 13 to be deposited in a special fund account in the Department of Agriculture and used to support the nursery inspection programs of the Department of Agriculture.

House Substitute No. 2 to House Bill 212 prohibits manufactured home community owners from increasing rent if the rent was increased by 5 percent or more the previous year or rental period, instead permitting an increase capped at 3 percent. This Act does not prohibit a community owner from increasing rent to market rent in phases as called for in current law, even if doing so would otherwise violate the prohibition on increasing rent after a 5 percent or more increase. It also allows a greater increase where more than 50% of the homeowners use the property as a second residence. This Act clarifies that penalties of rent reduction and repayment of excess rent will be imposed for a community owner who increases rent in violation of any provision of Title 25, Chapter 70.

This Act is the first leg of a constitutional amendment that provides for the Family Court to consist of 19 Judges including the Chief Judge, 10 who must be residents of New Castle County, 4 who must be residents of Kent County and 4 who must be residents of Sussex County at the time they apply for nomination by the Governor. This Act would increase the current Family Court bench by 2 Judges, 1 additional Judge from Kent County and 1 additional Judge from Sussex County.

This Act increases the number of statewide Family Court Commissioners from 5 to 7 with at least 2 of the Commissioners being assigned to Kent County and 2 of the Commissioners being assigned to Sussex County. This Act also requires all newly appointed Commissioners and reappointed Commissioners, upon application for nomination by the Governor, to reside in the county where they seek to be appointed. This Act will take effect on July 1,2024.

Section 1 of this bill moves the date of primary elections for statewide office, county office, and municipal office to the fourth Tuesday in April, which is the date of the presidential primary (in presidential election years). The dates for submitting and withdrawing notification of candidacy have been adjusted accordingly. Section 2 of the bill changes the deadline for a minor political party selecting its candidate at the partys convention. Section 3 of the bill changes the deadline for filing certificates of nomination from September 1st to April 1st. Section 4 changes the closed period in which a voter is not allowed to change his or her political affiliation to match the 60-day limit in 15 Del. C. § 3189 for presidential primaries.

This Act requires that parents and other persons under investigation for child abuse and neglect be given written and oral notice of the allegations made against them; the right to consult counsel prior to speaking with a DSCYF investigator; the right to refuse entry to the DSCYF investigator; the right to withhold consent to medical examinations of the children; the right to refuse to submit to a drug test; and the right to consult legal counsel prior to signing a safety plan.

This Act changes the composition of the Commission and further clarifies the definition of veterans as it pertains to this Section of Title 29. The Delaware Commission of Veterans Affairs is comprised of members, appointed by the Governor, who represent specific veteran organizations. The United States Congress defines the Korean War Era as June 27, 1950 to January 31, 1955, and today most living Korean War Veterans are in their upper 80s or lower 90s. This amendment will redesignate the seat to an organization that is self-perpetuating and whose membership will continue on, and also serve to provide the diverse representation of all veterans. Also preserved is the ability of the current Korean War Commissioner to remain as a Commissioner until his term expires or that seat otherwise becomes vacant. The sole remaining active Chapter of the Korean War Veterans of America in Delaware is in the process of being disbanded due to lack of membership.

This Act expands eligibility for the investment and employment credit against corporation income tax available under 30 Del. C. § 2011 to the operators of climate-controlled fruit or vegetable growing facilities with at least 400,000 square feet of enclosed space. Eligibility for the expanded tax credit is conditioned on a qualified investment of at least $40 million.

School personnel report that school safety is a significant issue that affects whether or not they stay in the profession. This Act makes recklessly or intentionally causing physical injury to an employee, contractor, or subcontractor of a public or private elementary school or secondary school an assault in the second degree. This Act may be cited as The School Personnel Protection Act.
