Specifies that certain state laws concerning the employment of minors do not prevent an employer from employing a minor who is at least 14 years of age as a farm laborer during school hours on a school day if particular requirements are met, including the submission of a statement from the minor's parent stating that the minor has withdrawn from school after completing grade 8 due to the parent's deeply held religious belief.

Free speech at state educational institutions. Provides that a state educational institution may not: (1) designate an outdoor area on campus as an area where protected expressive activities are prohibited; (2) deny any benefit or privilege to, or discriminate against, a religious, political, or ideological student organization for its protected expressive activity; and (3) deny a benefit to or discriminate against a religious, political, or ideological student organization based on the protected expressive activity or a requirement of the student organization. Allows a state educational institution to enforce reasonable time, place, and manner restrictions that comply with certain requirements. Requires a state educational institution to create and publish protected expressive activity policies. Provides that a student or student organization may bring a cause of action for a violation of free speech rights. Allows a court to award injunctive relief, compensatory damages, reasonable court costs, and attorney's fees to an aggrieved student or student organization if the court finds that a violation occurred. Allows a court to award compensatory damages up to $50,000. Provides that a state educational institution is not immune from certain liability. Requires the commission for higher education to create a form for a state educational institution to submit information on an alleged violation of this chapter. Makes conforming changes.

Child exploitation and child pornography. Provides that a person who knowingly or intentionally produces, disseminates, or possesses with intent to disseminate an image that depicts or describes sexual conduct: (1) by a child who the person knows is less than 18 years of age; (2) by a child who appears to be less than 18 years of age and the representation of the image is obscene; or (3) that is a representation of a child who appears to be less than 18 years of age and the representation of the image is obscene; commits the offense of child exploitation. Provides that a person who knowingly or intentionally receives, possesses, or accesses with intent to view an image that depicts or describes sexual conduct: (1) by a child who the person knows is less than 18 years of age; (2) by a child who appears to be less than 18 years of age and the representation of the image is obscene; or (3) that is a representation of a child who appears to be less than 18 years of age and the representation of the image is obscene; commits the offense of possession of child pornography. Specifies that it is not a required element of the offense of child exploitation or possession of child pornography that the child depicted actually exists under certain circumstances. Defines "image". Makes conforming changes.

Opioid litigation. Amends the deadline by which a political subdivision may opt back in to an opioid litigation settlement. Requires a political subdivision to submit a copy of the agreement executed between the political subdivision and the private legal counsel of the political subdivision when opting back into the opioid litigation settlement. Removes language providing that no political subdivision has any claim to any settlement proceeds for litigation against any opioid party not yet filed by the state as of a certain date. Removes certain requirements concerning the payment of costs, expenses, and attorney's fees and costs arising from opioid litigation. Changes the basis by which the agency settlement fund distributes funds to cities, counties, and towns. Reduces the percentage of opioid litigation settlement funds distributed for use of statewide treatment, education, and prevention programs for opioid use disorder. Provides that 35% of opioid litigation settlement funds are to be distributed to cities, counties, and towns for programs for treatment, prevention, and care that are best practices for opioid use disorder. Provides that funds received from the opioid settlement may not be distributed to a city, county, or town that has opted out of the settlement and that the remaining funds shall be distributed to the cities, counties, or towns that have opted into the settlement.

Risk based managed care and integrated care. Requires the office of the secretary of family and social services (office of the secretary) to apply to the United States Department of Health and Human Services for a Medicaid waiver or state plan amendment to implement, not earlier than January 1, 2024, a fee for service integrated care model program for specified category of Medicaid recipients. Sets forth requirements of the program. Sets forth certain requirements, including contract requirements for any contract between the office of the secretary and specified entities, in the operation of a risk based managed care program or integrated care model program for the specified covered population.

Driving record cards. Provides that an individual who is an Indiana resident and cannot provide proof of identity and lawful status in the United States may apply for a driving record card learner's permit and driving record card to obtain driving privileges. Provides that a driving record card learner's permit and driving record card may not be used for federal identification or any other federal purpose. Provides that a driving record card learner's permit and driving record card may not be used for the purpose of voting or employment verification. Requires an individual who holds a driving record card learner's permit or driving record card and operates a motor vehicle to verify and continuously maintain financial responsibility on any motor vehicle the holder operates in the amount required by law. Provides that the bureau of motor vehicles may not disclose certain information unless presented with a lawful court order or judicial warrant. Makes conforming amendments. Makes technical corrections.

Animal facility fire safety. Defines "animal facility". Makes it a Class C infraction if an animal facility fails to have: (1) certain automatic fire sprinkler systems; (2) certain automatic fire alarm systems; or (3) staff present at all times when dogs or cats are on the premises. Requires the state fire marshal to annually inspect certain animal facilities to determine compliance with fire sprinkler and fire alarm laws.

Professional counselors licensure compact. Requires the behavioral health and human services licensing board to administer the professional counselors licensure compact (compact). Adopts the compact. Sets forth requirements of a member state. Sets forth the duties and authority of the counseling compact commission (commission). Allows a counselor in a home state to practice via telehealth in a member state. Allows each member state to have one delegate on the commission. Establishes the procedure to withdraw from the compact. Makes conforming changes.

Closed captioning. Requires that an owner or operator of a public accommodation must activate closed captioning on all television receivers that are in use during regular hours. Allows the civil rights commission (commission) to investigate violations and enforce compliance. Provides that the commission may impose a civil penalty of $75 for each violation. Establishes certain notice requirements. Requires that the commission waive a civil penalty if an owner or operator complies not later than 30 days after a notice is mailed for the first violation.
