Public-private agreements. Provides that a governmental body may enter into a public-private agreement with respect to a transportation project. Provides that any public-private agreement with respect to a transportation project may use availability payments to finance all or a portion of the project. Provides that a governmental body may also enter into a development agreement with a private party for the development, construction, and financing of a privately owned and operated transportation or infrastructure project if the development agreement meets certain conditions. Specifies the contents of public-private agreements for transportation facilities or transportation projects and establishes requirements for the operator of the transportation facility or transportation project. Provides for a property tax exemption and a sales tax exemption. Defines terms.

Education matters. Defines a "qualified school". Requires each qualified school to post educational activities and curricular materials on the school's Internet web site. Provides that public records that are available on a qualified school's Internet web site shall be excepted from public record requests for individuals that have access to the school's Internet web site at the discretion of the qualified school. Requires the school corporation or qualified school to add functionality that allows parents of students in the school corporation to opt in to or opt out of certain educational activities and curricular materials under certain conditions. Provides that the governing body of a school corporation shall create a curricular materials advisory committee (committee) comprised of parents, teachers, administrators, and community members. Requires the committee to submit recommendations regarding curricular materials and educational activities to the governing body of a school corporation. Provides parameters for the composition of the committee, the appointment of committee members, and the appointment of a committee chairperson. Requires the governing body to create educational activities and curricular materials review, discussion, and recommendation procedures for the committee. Provides that the committee shall meet a certain number of times annually. Provides that a state agency, state educational institution, school corporation, or qualified school or an employee of the state agency, state educational institution, school corporation, or qualified school acting in an official capacity may not include or promote certain concepts as part of a course of instruction or in a curriculum or direct or otherwise compel a school employee or student to adhere to certain tenets relating to the individual's sex, race, ethnicity, religion, color, national origin, or political affiliation. Provides that a state agency, school corporation, qualified school, or state educational institution or an employee of the state agency, school corporation, qualified school, or state educational institution acting in an official capacity may not require an employee of the school corporation, qualified school, or state educational institution to engage in training, orientation, or therapy that presents any form of racial or sex stereotyping or blame on the basis of sex, race, ethnicity, religion, color, national origin, or political affiliation. Provides that a student shall not be required to participate in a personal analysis, an evaluation, or a survey that reveals or attempts to affect the student's attitudes, habits, traits, opinions, beliefs, or feelings without parental consent. Provides that, if a school corporation or qualified school uses a third party vendor in providing a personal analysis, evaluation, or survey that reveals, identifies, collects, maintains or attempts to affect a student's attitudes, habits, traits, opinions, beliefs, or feelings, the third party vendor and the school corporation or qualified school may not collect or maintain the responses to or results of the analysis, evaluation, or survey in a manner that would identify the responses or results of an individual student. Provides that before a school corporation or qualified school may provide or administer certain mental, social-emotional, or psychological services to a student, the school must provide the parent of the student or the student, if the student is an adult or an emancipated minor, with a written request for consent to provide or administer certain mental, social-emotional, or psychological services. Makes changes to the definition of "sexually explicit" for the purpose of trade regulation. Removes schools and certain public libraries from the list of entities eligible for a specified defense to criminal prosecutions alleging: (1) the dissemination of material harmful to minors; or (2) a performance harmful to minors. Adds colleges and universities to the entities eligible for a specified defense to criminal prosecutions alleging: (1) the dissemination of material harmful to minors; or (2) a performance harmful to minors.

Speeding. Provides that a person who knowingly, intentionally, or recklessly operates a vehicle at a speed more than 24 miles per hour above the posted maximum speed limit for a highway commits a Class C misdemeanor, unless the offense causes bodily injury to a person or damages the property of another person. Requires a juvenile court to recommend the suspension of the driving privileges of a child who causes bodily injury to a person while knowingly, intentionally, or recklessly driving more than 24 miles per hour above the posted maximum speed limit for a highway. Provides that the court shall require a delinquent child to pay the fine that would be imposed for a Class A misdemeanor if committed by an adult if the delinquent child caused bodily injury to a person while the delinquent child knowingly, intentionally, or recklessly drove more than 24 miles per hour above the posted maximum speed limit for a highway. Provides that an amount paid by a delinquent child must be deposited in the county's guardian ad litem fund or court appointed special advocate fund.

Pension investments in fossil fuel companies. Requires the board of trustees of the Indiana public retirement system (system) to divest investments and investment products in a company that is publicly traded and identified as one of the 200 largest reserve-owning fossil fuel companies based on the amount of carbon emissions in a company's oil, gas, and coal reserves. Requires the system to submit a report to the interim study committee on pension management oversight and the budget committee on or before November 1 of each year through 2029. Provides for civil immunity.

Teachers and counselors. Requires the department of education (department) to establish and maintain a data base of information concerning employees of public schools who were physically injured while on the job by students of the public schools. Requires public schools to provide information concerning an employee of a public school who was physically injured while on the job by a student of the public school. Requires: (1) teacher preparation programs to include content within the curriculum regarding; and (2) certain teacher training to include training on; conflict deescalation techniques and conflict prevention and intervention strategies. Provides that each school corporation and charter school that receives or has received funds from the Elementary and Secondary School Emergency Relief Fund (ESSER funds) shall prioritize the use of any ESSER funds the school corporation or charter school, after June 30, 2022, has or receives for hiring additional: (1) licensed school counselors; (2) licensed social workers; or (3) licensed school psychologists. Urges the legislative council to assign to the interim study committee on education the task of studying the impediments that may exist for underrepresented groups in seeking to become teachers and other licensed school employees.

Student health. Requires the governing body of a school corporation or chief administrative officer of a nonpublic school system to authorize the absence and excuse of a student due to the student's mental or behavioral health concerns. Limits the number of excused absences for mental or behavioral health concerns, without documentation, to three instructional days in a school year. Allows a student to be excused for more than three instructional days if the student provides certain documentation. Requires that a school selected to participate in the United States Centers for Disease Control and Prevention's Youth Risk Behaviors Survey or a successor survey participate in the survey. Provides that the commission for higher education shall, before January 1, 2023, work with the statewide suicide prevention coordinator to develop a suicide prevention training for students at each state educational institution (institution). Requires each student at an institution, after July 1, 2023, to participate in the training in the student's first year at the institution. Requires each institution to collect and report certain information concerning suicide prevention to the statewide suicide prevention coordinator. Establishes a mental health and suicide prevention in higher education task force (task force). Provides that the task force shall create a statewide suicide prevention resource guide for institutions. Makes conforming changes.

Medical cannabis. Defines "medical cannabis", specifies that the term does not include smokable cannabis or cannabis mixed with a food product, and permits the use of medical cannabis by a person with a qualifying medical condition as determined by the person's physician. Establishes a medical cannabis program (program) to permit the cultivation, processing, testing, transportation, and dispensing of medical cannabis by holders of a valid permit. Establishes the Indiana cannabis commission (commission) as a state agency to oversee, implement, and enforce the program, and establishes the commission advisory committee to review the effectiveness of the program. Requires that permit holders take steps to prevent diversion of cannabis to unauthorized persons. Requires that medical cannabis be properly labeled, placed in child resistant packaging, and tested by an independent testing laboratory before being made available for purchase. Prohibits packaging medical cannabis in a manner that is appealing to children. Authorizes research on medical cannabis in accordance with rules set forth by the commission. Makes conforming amendments.

Agricultural land used for wind or solar energy. Requires the Indiana utility regulatory commission (IURC) to include in its annual report to the governor and the chairman of the legislative council the following information concerning utility grade wind power devices (devices) and utility grade solar energy facilities (facilities) for each county in Indiana: (1) The total number of devices and facilities installed or under construction. (2) The total generating capacity of the devices and facilities. (3) The county's total land acreage that is occupied by, or otherwise part of a project or development that includes, one or more devices or facilities. (4) Of the occupied acreage, the percentage of that acreage that was assessed as agricultural land for property tax purposes: (A) as of the most recent assessment date; or (B) immediately before the commencement of construction of one or more devices or facilities on the land. Requires the IURC to present: (1) the IURC's annual report to the interim study committee on energy, utilities, and telecommunications (committee) before October 1 each year; and (2) the new information required under the bill: (A) before October 1, 2022, to the 21st century energy policy development task force; and (B) before October 1 of each year, to the standing committees of the senate and the house of representatives having subject matter jurisdiction over agricultural matters. Makes conforming amendments to the statute governing the committee's duties to monitor changes and competition in the energy utility industry.

Veterinary medicine. Changes the name of the Indiana board of veterinary medical examiners to the Indiana board of veterinary medicine (board). Provides that the state veterinarian: (1) serves as the chief administrative officer of the board; (2) performs the duties delegated by the board to the state veterinarian; and (3) provides technical advice and assistance to the board. Establishes the Indiana center for animal policy (center) to facilitate the coordination of regulatory duties of the state board of animal health (BOAH) and the board. Provides that the state veterinarian is the chief administrative officer of the center and the BOAH. Requires that the BOAH (not the professional licensing agency) perform certain administrative functions for the board. Requires that the board and the division of consumer protection, office of the attorney general enter into a memorandum of understanding to share information concerning complaints and investigations against individuals regulated by the board. Allows the board to adopt emergency rules. Provides that the board, and the state veterinarian if authorized by the board, may subpoena witnesses and compel the production of certain documents as part of an investigation. Changes the name of the veterinary investigative fund to the veterinary medicine fund (fund). Makes various changes to the fund. Provides that the changes made by the bill do not apply until July 1, 2023. Provides for transition and makes conforming changes.

Teacher compensation and collective bargaining. Provides that, in calculating whether a school corporation has met the 45% teacher compensation threshold, a school corporation: (1) may include only salaries paid from the state tuition support distributions during the state fiscal year; and (2) shall count the total funds received in state tuition support distributions to the school corporation during the state fiscal year. Provides that a school corporation is not considered to be in deficit financing if the sum of the ending respective cash balance on June 30 of the immediately preceding state fiscal year of: (1) the school corporation's rainy day fund; plus (2) the school corporation's education fund; exceeds an amount equal to 20% of the school corporation's most recently adopted annual budget. Requires a school employer to bargain collectively class size, health and safety matters, and teacher preparation time with an exclusive representative.

Automated traffic control system pilot program. Provides that the Indiana department of transportation (department) may establish the automated traffic control system pilot program (program) for the purpose of enforcing work zone speed limits. Provides that, if the department establishes the program, the department shall work with the state police department to enforce the program. Provides that the department and the state police department may enter into an agreement to implement the program. Provides that the program expires on July 1, 2026. Adds an entry to the statutory list of crimes codified outside of Title 35.
