Watercraft registration renewal fee. Changes the formula for determining the fee for renewal of a watercraft registration. Determines the registration renewal fee amount for a watercraft according to which of 14 classes the watercraft falls into based on the value of the watercraft when it was new. Provides that the proceeds of each watercraft registration renewal fee shall be distributed as follows: (1) $5 shall be deposited in the fish and wildlife fund; (2) 75% of the remainder shall be deposited in the lake and river enhancement fund; and (3) 25% of the remainder shall be deposited in the conservation officers marine enforcement fund.

Wake boarding and wake surfing. Specifies restrictions that apply to wake boarding or wake surfing on a public freshwater lake. Establishes a penalty. Prohibits operation of a motorboat with: (1) an outboard motor; or (2) an outdrive unit; with a propeller that extends past the motorboat's transom, swim platform, boarding platform, swim step, or swim ladder for the purpose of wake surfing.

Killing a law enforcement animal. Increases the penalty for killing a law enforcement animal to a Level 5 felony. Provides that killing a law enforcement animal in the commission of a crime is an aggravating circumstance for sentencing in criminal cases.

High value workforce ready credit-bearing grant. Provides that an applicant who has previously received a baccalaureate degree or an associate degree may be eligible for a high value workforce ready credit-bearing grant if the applicant: (1) received a diploma of graduation, high school equivalency certificate, or state of Indiana general educational development diploma five or more years before the applicant applies for a grant; and (2) is not working in the subject matter field in which the applicant received the baccalaureate degree or associate degree. (Current law provides that an applicant for a high value workforce ready credit-bearing grant may not have previously received a baccalaureate degree, an associate degree, or an eligible certificate.)

Adoption of food and beverage taxes. Provides that a local unit fiscal body may impose a uniform food and beverage tax if the local unit is not required or authorized to impose a food and beverage tax under any other law (other than the stadium and convention funding food and beverage tax). Provides that a local unit must receive legislative approval to impose a food and beverage tax. Provides that the local business community or a group of local businesses that would be required to collect the tax must show support for the tax. Provides that a local unit fiscal body must pass a resolution of support and intent to approve a food and beverage tax under this chapter. Provides that after a local unit passes a resolution of support to approve a food and beverage tax, the local unit may adopt an ordinance to impose an excise tax. Specifies that the tax rate may not exceed 1% and must be imposed in increments of 0.25%. Provides that a group of three or more local units working toward a common project may impose a tax rate of up to 3%. Provides that revenue from the tax may be used by the local unit, after appropriation by the local unit fiscal body, only for: (1) capital improvements that promote economic development and complement and enhance the level of visitation in the local unit, including fairgrounds, convention centers, or conference centers; (2) certain costs that are necessary or useful for such a capital improvement; and (3) paying the principal and interest of any bonds issued or lease rental payments for a lease entered into for these purposes. Specifies that the tax revenue may not be used to: (1) pay for any operating expenses of an operating capital project; or (2) pay any local unit operating expenses. Authorizes the local unit fiscal body to pledge the tax revenue to pay bonds issued, loans obtained, and lease payments or other obligations incurred by or on behalf of the local unit for purposes authorized under the uniform food and beverage tax law. Specifies that a uniform food and beverage tax imposed in a local unit remains in effect until the expiration of the capital improvement bond or lease being used to carry out the capital improvements.

Provides that the program and fund are administered by the Indiana criminal justice institute (institute). Defines a "qualified law enforcement agency". Pediatric cancer research and treatment grant. Establishes the pediatric cancer research and treatment grant program (grant program) to be administered by the Indiana department of health (state department). Establishes the pediatric cancer research and treatment fund and appropriates $2,000,000 to the fund for the biennium. Sets forth requirements for an entity to receive a grant. Requires the state department to develop criteria, policies, procedures, and a plan concerning awarding of the grants. Prioritizes use of the funds to be on innovative research and treatments with the potential of resulting in novel therapies for pediatric cancer. Requires the state department to submit an annual report to the governor and legislative council concerning the grant program and publish the report on the state department's website.

Home warranties and regulation of residential structures. Allows a builder to disclaim implied warranties for a new home that is first occupied by a person renting the home as a residence from the initial home buyer. Allows a builder to disclaim implied warranties on a model home in the same manner as a home that is first occupied as a residence. Prohibits regulation of a mobile home, a manufactured home, or an industrialized residential structure on private property (other than within a mobile home community) based on age. Allows the owner of a legal, nonconforming residential structure on private property that is damaged or destroyed to replace or repair the structure without losing legal nonconforming use status as long as the structure continues to be used for residential purposes. Provides that a comprehensive plan and ordinance in a county (other than Marion County) may not preclude the installation of manufactured homes that exceed a certain width (in addition to a certain square footage) as permanent residences on a lot on which any other type of dwelling unit may be placed. Provides that after June 30, 2023, a mobile home, a manufactured home, or an industrialized residential structure is not considered a new home or model home subject to the provisions concerning home warranties. Prohibits a county, city, or town from exercising its planning and zoning authority in a way that differentiates between fraternity and sorority houses on the sole basis of whether the fraternity or sorority is officially approved or recognized by the college or university.

IFA approval and revolving loan programs. Provides that a participant may issue and sell bonds to the Indiana finance authority (authority) without the requirement of an increase to the user rates and charges of the participant. Provides that the bonds must be issued under a resolution or ordinance and the proceeds must be used to carry out the purposes allowed by the program. Defines the term "independent evaluator" for purposes of non-revenue water audits. Requires a water utility to annually perform an audit of its water distribution system through the use of the latest version of the American Water Works Association's free water audit software or other methodology software to determine the causes of the water utility's non-revenue water. Provides that the issuance, by the ports of Indiana, of both taxable and tax exempt revenue bonds of the state, payable solely from revenues for the purpose of paying all or any part of the cost of a port or project, is subject to the prior approval of the authority. Provides for the appointment of a nine member board of directors of the Indiana Secondary Market for Education Loans, Inc. (ISMEL). Provides that ISMEL may only borrow money after consulting with the authority not less than three months before ISMEL begins the process of borrowing money. Requires ISMEL to, at least 30 days prior to the issuance or placement of any bond, note, or other instrument, report to the budget committee the estimated amount of the bonds.

Expiration of committees and interstate compacts. Provides that a committee, board, commission, or task force (committee) created by the general assembly after June 30, 2023, expires if the committee does not meet within two years after the effective date of the statute creating the committee. Provides that the statutes creating the following compacts expire July 1, 2025: (1) The Interstate Jobs Protection Compact. (2) The Interstate High Speed Intercity Rail Passenger Network Compact. (3) The Interstate Compact on Community Corrections Transfers. Requires the governor to give notice to each state, if any, that is a party to each compact that the state of Indiana is withdrawing from the compact. Requires the governor to certify before January 1, 2024, with respect to each compact, that notice either: (1) has been given regarding Indiana's withdrawal from the compact; or (2) was not required to be given because there are no other party states to which to give notice.
