Disposal of firearms by trade for new equipment. Permits a law enforcement agency to dispose of certain confiscated firearms by trade with a licensed firearms dealer, a licensed firearm manufacturer, or another law enforcement agency in exchange for new firearms and other law enforcement equipment. Sets forth the recording and reporting requirements for the trade of firearms by a law enforcement agency.

Outdoor refreshment areas. Allows a city or town to designate an outdoor location as a refreshment area with the approval of the alcohol and tobacco commission (commission). Provides that if a refreshment area is approved, the commission designates retailer permittees that may sell alcoholic beverages for consumption within the refreshment area. Prohibits a refreshment area from being located near a school or church unless the school or church does not object. Allows a minor to be within the refreshment area. Makes it a Class C infraction for a participating retailer permittee or vendor to: (1) sell a person more than one alcoholic beverage at a time or an alcoholic beverage that exceeds the volume limitations; or (2) allow a person who is not wearing a wristband identification to enter the refreshment area with an alcoholic beverage.

Financial literacy. Provides that, beginning with the cohort of students who are expected to graduate from a public school, a charter school, or a state accredited nonpublic school in 2027, a student must successfully complete a personal financial responsibility course before the student may graduate.

Conduct of CDL physical by physical therapists. Defines "certified medical examiner". Provides that, unless there is a conflict with federal law or the orders, standards, or regulations of the Federal Motor Carrier Safety Administration (FMCSA), a licensed physical therapist may perform an examination (exam) for an applicant for an initial or a renewal commercial driver's license or commercial learner's permit that is within the physical therapist's scope of practice. Provides that a physical therapist who performs an exam is subject to the requirements of the FMCSA for a certified medical examiner.

Telehealth services. Provides (beginning January 1, 2024) that the office of Medicaid policy and planning may not require: (1) a provider that is licensed, certified, registered, or authorized with the appropriate state agency or board and exclusively offers telehealth services to maintain a physical address or site in Indiana to be eligible for enrollment as a Medicaid provider; or (2) a telehealth provider group with providers that are licensed, certified, registered, or authorized with the appropriate state agency or board to have an in-state service address to be eligible to enroll as a Medicaid vendor or Medicaid provider group.

Health care staffing. Requires a hospital to establish a nurse staffing council or assign the functions of the council to an entity in the hospital to develop a nurse staffing plan and review any reported deviations from the plan. Prohibits a hospital from taking certain actions against an employee or contract worker for filing a deviation report. Prohibits a hospital, ambulatory outpatient surgery center, health facility, or residential care facility from requiring a registered nurse or licensed practical nurse to work mandatory overtime. Establishes exceptions. Prohibits a hospital, ambulatory outpatient surgery center, health facility, or residential care facility from taking certain actions against an employee who does not consent to work mandatory overtime.

Service animals. Provides that only a dog or miniature horse qualify as a service animal. Provides that a public accommodation shall make reasonable modifications in policies, practices, or procedures to permit the use of a miniature horse by an individual with a disability. Sets forth certain requirements when permitting or not permitting a person with a disability to bring a service animal on the premises of a public accommodation.

Cannabis. Decriminalizes the possession of: (1) two ounces or less of cannabis; or (2) five grams or less of hash oil or hashish. Establishes a per se intoxication level of 10 nanograms of THC per milliliter of whole blood for purposes of operating while intoxicated laws, and requires that the analysis of controlled substances in a person's blood measure only the controlled substance and not the metabolites of the controlled substance. Repeals the term "marijuana" and replaces with the term "cannabis". Makes conforming changes.

Transition from Marketplace plan to Medicare. Requires an insurer or health maintenance organization that provides coverage under an Affordable Care Act Marketplace (Marketplace) plan to provide to each individual covered under the Marketplace plan, not more than two months before the birthday on which the individual will become 65 years of age, a written message that includes: (1) a statement that the individual will be eligible to enroll in Medicare during the individual's initial enrollment period, which begins three months before the individual becomes 65 years of age; (2) a statement advising the individual that, in most cases, someone covered by a Marketplace plan will want to end their Marketplace coverage upon becoming eligible for Medicare; and (3) detailed instructions that the individual may follow to cancel the individual's Marketplace plan. Prohibits an insurer or health maintenance organization from collecting a premium for an individual's Marketplace plan coverage after the earlier of: (1) the birthday on which the individual becomes 65 years of age; or (2) the date on which the individual's Medicare coverage begins. Requires an insurer or health maintenance organization to return the part of any premium that was collected for an individual's Marketplace plan coverage but was not earned as of the birthday on which the individual becomes 65 years of age. Empowers the insurance commissioner to impose a civil penalty on or suspend or revoke the certificate of authority of an insurer or health maintenance organization that commits a violation.

Digital literacy pilot program. Establishes the digital literacy pilot program (pilot program) and fund. Provides that the department of education (department) shall administer the pilot program. Provides that the department may approve: (1) one or more program providers to participate in the pilot program; and (2) a school corporation or charter school to participate in the program; if the school corporation, charter school, and program provider meet certain requirements. Appropriates $500,000 to the digital literacy pilot program fund for each of the following: (1) 2024 state fiscal year. (2) 2025 state fiscal year. (3) 2026 state fiscal year.

Resources for committed offenders upon release. Requires the department of correction (department) to provide: (1) a short term supply of medication to certain Medicaid eligible committed offenders and a discharge summary of the medications provided to the committed offender during the committed offender's term of incarceration; (2) assistance to obtain certain documentation; and (3) assistance in obtaining a credential from the bureau of motor vehicles at the time of the committed offender's release on parole, assignment to a community transition program, or discharge from the department. Provides Medicaid coverage for a prescription provided by the department at the time of an offender's release on parole, assignment to a community transition program, or discharge from the department.

Violence prevention services. Requires the office of the secretary of family and social services to, before December 1, 2023, apply to the United States Department of Health and Human Services for a waiver or an amendment to the state Medicaid plan to require reimbursement for eligible community violence prevention services provided by a certified violence prevention professional for certain eligible Medicaid recipients. Requires the Indiana department of health to approve at least one accredited violence prevention professional training and certification program (program) that includes certain criteria. Provides that in order to be certified as a violence prevention professional, a prevention professional shall complete the program.

Funding of juvenile justice oversight. Makes certain amendments to the juvenile diversion grant program, the juvenile community alternatives grant program, and the juvenile behavioral health competitive grant pilot program (programs). Appropriates specified amounts for the state budget biennium to the juvenile diversion and community alternatives grant program fund and juvenile behavioral health competitive grant pilot program fund for purposes of those programs to be administered by the Indiana criminal justice institute in consultation with the juvenile justice oversight committee (oversight committee) and the grant process workgroup created by that oversight committee, taking into considering the grant program report prepared and submitted to the commission on improving the status of children in Indiana by the oversight committee.

Child protection. Adds a school's human resources professional to the list of people to whom records that are sealed by the central repository for criminal history information maintained by the state police department may be disclosed. Provides that a person at least 18 years of age who knowingly or intentionally communicates with an individual whom the person believes to be a child less than 18 years of age concerning sexual activity with the intent to gratify the sexual desires of the person or the individual commits inappropriate communication with a child, a Class B misdemeanor. (The current law is less than 14 years of age for the child victim.)
