Criminal mischief and criminal trespass. Provides that a person who recklessly, knowingly, or intentionally damages the property of a scientific research facility without the consent of, or with consent which was fraudulently obtained from, the owner, possessor, or occupant of the property that is damaged commits criminal mischief, a Class A misdemeanor. Provides that a person who, not having a contractual interest in the property, knowingly or intentionally enters the real property of a scientific research facility without the permission of, or with permission which was fraudulently obtained from, the owner of the scientific research facility or an authorized person, and knowingly or intentionally engages in conduct that causes property damage to: (1) the owner of or a person having a contractual interest in the scientific research facility; (2) the operator of the scientific research facility; or (3) a person having personal property located on the property of the scientific research facility; commits criminal trespass, a Level 6 felony.

Elements of rape. Provides that a person commits rape, a Level 3 felony, if the other person submits to the sexual intercourse or other sexual conduct under the belief that the person committing the act is someone the victim knows, other than the person committing the act, and such belief is intentionally induced by any artifice, pretense, or concealment practiced by the person.

Machine guns. Revises, for purposes of an enhancement and certain criminal offenses, a definition of "machine gun". Provides that particular criminal offenses concerning machine guns do not apply to certain persons, including persons possessing machine guns or other items not required to be registered in the National Firearms Registration and Transfer Record maintained by the federal Bureau of Alcohol, Tobacco, Firearms and Explosives. Makes a conforming amendment.

Firearm storage. Prohibits a person from keeping or storing a loaded firearm on any premises controlled by the person if the person knows, or reasonably should know, that a child is likely to gain access to the firearm. Provides that a child's possession of a firearm resulting from a person's knowing or intentional failure to secure a firearm is a Class C misdemeanor. Provides that the offense is a Class B misdemeanor if the person has a prior unrelated conviction for the offense. Specifies certain defenses. Provides that a child's use of an unsecured firearm resulting in injury or death to any other person due to a person's knowing or intentional failure to secure a firearm is a Class A misdemeanor. Provides that the offense is a Level 6 felony if the person has a prior unrelated conviction for the offense. Specifies certain defenses. Specifies certain sign requirements for retail dealers. Defines certain terms. Makes conforming amendments.

Natural resource entrance fees. Allows counties that meet certain criteria to adopt an ordinance to impose a surcharge of not more than $2 in addition to the fees charged by the department of natural resources (department) for entry into certain state parks and recreation areas. Provides that the surcharge may not be imposed on: (1) a county resident; or (2) an annual state park pass holder. Requires the department to collect, report, and pay the surcharge to each county treasurer. Provides that the revenue collected is to be used for: (1) public safety purposes; or (2) improvement of reservoir water quality.

Credentialing for Medicaid services. Requires the office of Medicaid policy and planning (office) to prescribe a credentialing application form to be used by: (1) a provider who applies for credentialing by a managed care organization or a contractor of the office (contractor); and (2) a managed care organization or contractor that performs credentialing activities. Requires a managed care organization or contractor to notify a provider concerning: (1) any deficiency in the provider's unclean credentialing application; and (2) the status of the provider's clean credentialing application. Provides that if the managed care organization or contractor fails to issue a credentialing determination within 30 days after receiving a provider's completed credentialing application, the managed care organization or contractor shall provisionally credential the provider if the provider meets certain criteria. Provides that if the managed care organization or contractor fully credentials a provider, then reimbursement payments to the provider shall be paid retroactive to the date on which the initial credentialing application was received and the provider shall be reimbursed at the rates determined by the contract between the provider and the managed care organization or contractor.

Railroad investment tax credit. Provides that a railroad company that is classified as a Class II or Class III carrier is entitled to a credit against the railroad company's state income tax liability equal to 50% of the amount of qualified railroad expenditures or qualified new rail infrastructure expenditures made by the railroad company during the taxable year. Provides that: (1) for qualified railroad expenditures, the credit may not exceed an amount equal to the product of: (A) $5,000; multiplied by (B) the number of miles of railroad track owned or leased in Indiana by the taxpayer as of the close of the taxable year; and (2) the total amount of credits authorized for qualified railroad expenditures may not exceed $9,500,000 annually. Provides that: (1) for qualified new rail infrastructure expenditures, the amount of the credit may not exceed $500,000 for each project; and (2) the total amount of credits authorized for qualified new rail infrastructure expenditures may not exceed $10,000,000 annually.

Notice of change to provider agreement. Requires an insurer and a health maintenance organization to provide a contracted provider with a current reimbursement rate schedule: (1) every two years; and (2) when three or more Current Procedural Terminology (CPT) code rates change in a 12 month period. Requires an insurer and a health maintenance organization to provide a contracted provider with notice of a proposed material change to the agreement between the insurer or health maintenance organization and the contracted provider at least 90 days prior to the proposed effective date. Establishes requirements for the contents of a notice of a proposed material change. Requires an insurer or health maintenance organization to provide a contracted provider with notice at least 15 days prior to a change to an existing prior authorization, precertification, notification, referral program, edit program, or specific edits.

Mental health care for veterans with PTSD. Establishes the returning Hoosier warrior mental health wellness pilot program (pilot program). Provides that the Indiana department of veterans' affairs shall administer the pilot program. Provides that a qualified service member may receive certain financial assistance from the military family relief fund for treatment of posttraumatic stress disorder (PTSD). Provides that the pilot program is funded by the fund. Requires, for the state fiscal year beginning after June 30, 2023, and ending before July 1, 2024, that the department of insurance deposit $10,000,000 of insurance premium tax collected into the fund.
