Public defender participation in PARF. Adds a person who serves in one of the following positions on or after January 1, 2014, to the prosecuting attorneys retirement fund (PARF): (1) The state public defender or the second highest paid staff person employed by the state public defender. (2) The executive director of the public defender council of Indiana or the second highest paid staff person employed by the public defender council of Indiana. (3) The highest paid or the second highest paid staff person employed by the Indiana public defender commission. (4) A chief public defender or chief deputy public defender. Allows staff attorneys of the prosecuting attorneys council of Indiana employed on or after January 1, 2012, to participate in PARF. Changes the name of the prosecuting attorneys retirement fund to the prosecuting attorneys and public defenders retirement fund. Provides that after a participant has contributed to PARF for 22 years, the state or county shall pay the contributions to the fund for the participant. Provides that the computation of benefits is based in part on the highest salary that was paid to the participant before separation from service. Provides that 1% shall be added to the percentage used to calculate benefits for each year of service after 22 years. Provides that a reduced annual retirement benefit equals the benefit that would be payable if the participant were 65 years of age reduced by 0.10% for each month before the participant's sixty-fifth birthday. Allows a participant to receive service credit in PARF for more than one year and less than 10 years of service received by the participant in the public employees' retirement fund under certain conditions. Provides for the calculation of an offset of PARF benefits payable to a participant from a participant's public employees' retirement fund benefits based on the concurrent service and wages the participant earned in both the public employees' retirement fund and PARF. Makes corresponding changes.

Employer tax credit for apprenticeship programs. Provides for a nonrefundable apprenticeship tax credit (credit) for an eligible employer. Provides that the amount of the credit is equal to not more than $1,250 for each apprentice employed. Provides that an eligible employer may claim: (1) a credit for not more than 10 apprentices employed for a taxable year; and (2) the credit for an individual apprentice for not more than three taxable years. Provides that the total amount of credits that may be awarded for a state fiscal year may not exceed $10,000,000. Allows the department of state revenue to adopt rules to implement the credit.

Charter school matters. Provides all charter schools access to loans through the Indiana bond bank. Requires a county auditor to distribute a portion of revenue received from a school corporation's operations fund property tax levy to each: (1) charter school in which students who receive not more than 50% virtual instruction and who have legal settlement in the school corporation attend; and (2) transferee school corporation that a transferred student who has legal settlement in the school corporation attends. Phases in the distributions over three years. Provides that, for a resolution to adopt a school operating referendum tax levy adopted after June 30, 2023, a county auditor must distribute a portion of revenue received from the levy or school safety referendum tax levy to each transferee school corporation and charter school in which students who receive not more than 50% virtual instruction and who have legal settlement in the school corporation attend. Provides that if a charter school receives a distribution from a school corporation from a school operating referendum tax levy or a school safety referendum tax levy, the charter school must post certain information on the charter school's website. Provides that a charter school or transferee school corporation that may receive money from a school operating referendum tax levy or a school safety referendum tax levy may not promote a position on a referendum, in the same manner as a school corporation is prohibited from promoting a position on a referendum. Provides that the maximum length of a charter is 15 years. (Current law provides that the maximum length of a charter is seven years.) Amends the definition of "school building construction program" to: (1) include the purchase, lease, or financing of land, the construction and equipping of school buildings, and the remodeling, repairing, or improving of school buildings by a charter school; and (2) replace "adjusted assessed valuation" with "assessed valuation" with regard to school corporation eligibility for an advance from the common school fund. Establishes the public school options program and fund. Provides that a charter school (excluding a virtual charter school or adult high school) may receive an advance from the common school fund if the charter school's authorizer approves the application. Provides that the state board of education shall repay a charter school's advance from proceeds in the public school options fund. Provides that the department of state revenue shall make a distribution from the state retail and use tax that it collects to the public school options fund. Makes conforming amendments. Makes a technical correction.

Education matters. Provides that a school, an employee or staff member of a school, or a third party vendor used by a school to provide instruction may not provide any instruction to a student in prekindergarten through grade 3 on human sexuality. Provides that a school employee or a school staff member is not prohibited from responding to a question from a student regarding certain topics. Requires a school to notify in writing at least one parent of a student, if the student is an unemancipated minor, of a request made by the student to change the student's name or pronoun, title, or word to identify the student.

Workforce development matters. Repeals provisions concerning the work Indiana program. Defines "adult education and literacy activities" and requires that certain money appropriated by the general assembly be used for workforce preparation activities and integrated education and training. Removes or amends certain provisions regarding: (1) reimbursements to eligible providers for adult education that is provided to certain individuals; and (2) adult education grants provided to employers of eligible employees. Allows the department of workforce development to grant a specified diploma to an individual who demonstrates high school level skills through certain competency based assessments and obtains an industry recognized credential. Specifies the meaning of "authorization" for the purpose of certain provisions related to postsecondary proprietary educational institutions. Makes conforming changes.

Exemption from prior authorization requirements. Amends the law concerning the prior authorization of health care services by a health plan (which includes a policy of accident and sickness insurance, a health maintenance organization contract, and the Medicaid risk based managed care program). Provides that: (1) if a health plan, during a six month evaluation period, approves at least 90% of a health care provider's requests for prior authorization for a particular type of health care service, the health plan may not require the health care provider to obtain prior authorization for that type of health care service for the entire duration of an exemption period of six calendar months immediately following the evaluation period; and (2) at the conclusion of the initial exemption period, the health plan shall continue granting consecutive exemption periods of six months to the health care provider unless the health plan rescinds the exemption. Provides that a health plan may rescind a health care provider's exemption only on the basis of a determination by a physician that, in at least five and not more than 20 cases randomly selected for review, less than 90% of the health care services provided by the health care provider met the health plan's medical necessity criteria. Authorizes a health care provider that is notified of the rescission of its exemption to initiate a review of the rescission by an independent review panel. Requires the independent review panel to determine whether at least 90% of the health care services provided by the health care provider met the health plan's medical necessity criteria. Requires a health plan to restore the health care provider's exemption if the independent review panel's determination is in favor of the health care provider. Requires the insurance commissioner to adopt rules.

Legalization of cannabis. Legalizes the sale and use of cannabis by a person at least 18 years of age. Requires the Indiana department of health to establish a program to issue a medical cannabis identification card to a patient whose physician has recommended cannabis to treat a medical condition. Permits the sale of cannabis to a person less than 18 years of age if the person has been issued a medical cannabis identification card, and exempts purchases by a medical cannabis cardholder from sales tax. Makes conforming amendments.
