Limitations on interests of foreign countries. Prohibits the state, a state agency, and a political subdivision from entering into a contract with a prohibited person for the provision of goods or services. Amends the amount of a gift received from a foreign source that must be reported by a postsecondary educational institution. Prohibits certain individuals and business entities from purchasing real property located within Indiana. Permits the attorney general to investigate and issue subpoenas upon receipt of information that leads the attorney general to believe a violation of the critical infrastructure or foreign ownership of real property statutes has occurred. Permits the attorney general to bring an action on behalf of the state or a political subdivision for a violation of the critical infrastructure and foreign ownership of real property statutes.

Human trafficking awareness training. Requires an owner or operator of a public lodging establishment (establishment) to: (1) provide human trafficking awareness training for employees; (2) post human trafficking awareness signage; and (3) implement procedures for the reporting of suspected human trafficking and a human trafficking prevention policy. Requires the department of homeland security (department) to make a list available on the department's website of approved human trafficking training courses. Provides that an owner, operator, or employee of an establishment that complies in good faith with the requirements is not liable for an act or omission arising out of or related to human trafficking committed by a third party unless the owner, operator, or employee knowingly and willfully assists in the commission of human trafficking. Requires the department to maintain a list of establishments that are not in compliance with the requirements. Requires a state agency to ensure that lodging for an employee of the state agency is booked in an establishment that is not on the list. Requires the department to adopt rules to implement the requirements, including rules establishing a schedule of fines for a violation.

State educational institutions. Requires a state educational institution (institution) to disclose certain foreign gifts and contracts received or entered into after December 31, 2020. Requires the commission to establish and maintain a website for accessing information about disclosed gifts and contracts. Authorizes the commission to provide for an audit of an institution's use of a disclosed gift, or the proceeds of a disclosed contract, received or entered into after June 30, 2021, and before July 1, 2024. Authorizes the attorney general to bring a cause of action to enforce the disclosure statute. Requires the board of trustees of an institution to adopt a policy prohibiting the transfer, licensing, or sublicensing of intellectual property developed using the institution's resources to: (1) a business entity organized under the laws of a foreign adversary; (2) a business entity headquartered in a foreign adversary; or (3) a business entity or other entity, including a governmental entity, that is owned or controlled by citizens of, or is directly controlled by the government of, a foreign adversary. Requires the board of trustees of each institution to adopt a policy prohibiting an employee or contractor of the institution from making a public statement in the employee's or contractor's official capacity unless the statement: (1) relates to the operation of the institution, or to an institution sponsored event; or (2) has been approved by the board of trustees. Prohibits an institution from using state funds or resources to: (1) engage or contract with an individual associated with a foreign terrorist organization or a state sponsor of terror; or (2) support the activities of a foreign terrorist organization or a state sponsor of terror.

Public employers. Prohibits a public employer from requiring or stating a preference for a postsecondary degree for employment, rejecting an applicant solely on the basis of the applicant lacking a postsecondary degree, or giving preferential treatment to an applicant who holds a postsecondary degree. Provides an exemption if the job duties require a postsecondary degree and the public employer demonstrates the necessity of a specific postsecondary degree in the job posting. Requires a public employer to provide written notice to each applicant who has been eliminated from hiring consideration. Allows an applicant to appeal a hiring decision to the department of labor (department) if the applicant believes the decision was based on the applicant's lack of a postsecondary degree. Allows any person to report to the department a job posting that includes a requirement or preference for a postsecondary degree and fails to include an explanation of the necessity of the postsecondary degree. Requires the department to take certain actions if an appeal or a report is substantiated by the department.

Foreign ownership of land. Provides that, beginning July 1, 2024, a prohibited person may not purchase, lease, or acquire a parcel of real property that is: (1) located in Indiana; and (2) located within a 10 mile radius of a military installation; with certain exceptions. Provides that, beginning July 1, 2024, a prohibited person may not acquire or lease agricultural land or a mineral right or water or riparian right on agricultural land located in Indiana. Provides certain enforcement powers to the attorney general for a transfer of land in violation of the law.

Breakthrough therapies. Establishes the breakthrough therapies research fund. Provides that a drug, biological product, or medical device that has been designated as a breakthrough therapy under federal law may be made available to a qualified patient and offered by a physician as a part of the patient's medical treatment. Specifies that a civil or criminal cause of action is not created against a manufacturer or health care provider for any harm to a qualified patient resulting from use of an investigational drug, biological product, or device.

Road funding. Provides that the amounts currently distributed from the motor vehicle highway account and the local road and street account to counties, cities, and towns based upon the proportionate share of road and street mileage shall instead be distributed based on the proportionate share of road and street vehicle miles traveled. Provides that the Indiana department of transportation shall establish guidelines outlining the procedures required to determine vehicle miles traveled. Changes references from the "auditor of state" to the "state comptroller" to conform with P.L.201-2023.

Homeowners association covenants. Requires the owner of a property to disclose in the disclosure form the following: (1) That the property is in a community governed by a homeowners association. (2) A copy of the recorded governing documents. (3) A statement indicating whether there are assessments and the amount of any assessments. (4) The name and business or home address of a board member, homeowners association agent, or other person who has a contract with the homeowners association to provide any management services for the homeowners association. Special service review team and emergency placement. Establishes the special service review team to review denied applications and applications for which a determination has not been made for the community integration and habilitation waiver. Limits the geographical area of review. Establishes reporting requirements. Requires the division of disability and rehabilitative services to obtain consent from a waiver applicant in order to share the application and information accompanying the application with the review team. Provides immunity for an employee who obtains consent and provides the information in good faith. Provides that the review team expires December 31, 2026. Makes changes to the situations in which an emergency placement priority may be provided for individuals under a Medicaid waiver.

Medicaid matters. Allows a provider that has entered into a contract with a managed care organization, after exhausting any internal procedures of the managed care organization for provider grievances and appeals, to request an independent review of the managed care organization's action with an independent third party provider selected by the office of Medicaid policy and planning. Establishes a procedure for an independent third party provider to review an action of a managed care organization. Prohibits a provision in a contract between a provider and a managed care organization that would negate or restrict the right of a provider to an independent review and provides that such a contract provision is void and unenforceable. Provides that if the office of the secretary of family and social services (office) or a contractor of the office fails to pay or denies a clean claim for any eligible Medicaid service within certain time limits due to the office or contractor incorrectly processing the clean claim because of errors attributable to the internal system of an insurer or managed care organization, the office or contractor may not assert that the provider failed to meet the timely filing requirements for the claim. Changes the membership of the Medicaid advisory committee (committee). Allows a member of the committee whose position was eliminated to continue to serve until the member's term expires. Establishes co-chairs for the committee and provides that the elected co-chair of the committee serves for a two year term. Requires the office to prepare a report that describes every type of report that must be prepared by a Medicaid contractor or managed care entity and submitted to the office or the office of Medicaid policy and planning. Specifies the information that must be contained in the report. Requires the office to submit the report to the committee and the general assembly. Requires the committee to hold public hearings on the report. Makes technical changes.
