Air quality. Authorizes a town, city, or county to establish or designate an agency to act for the town, city, or county as a local air pollution control agency (agency). Requires the commissioner of the department of environmental management (department) to enter into a contract with the agency of a town, city, or county if the agency is willing to enter into the contract. Provides that a contract between the department and the agency of a town, city, or county must: (1) require the department to advise, cooperate with, and provide technical assistance to the agency; (2) authorize the agency to undertake air pollution control activities on behalf of the department or in enforcement of ordinances of the town, city, or county; and (3) provide for the payment of fair monetary compensation for the air pollution control activities performed by the agency. Provides that: (1) the compensation paid to an agency under a contract must be at least sufficient to cover the agency's staffing and operating costs; and (2) the rate of compensation must be adjusted each year according to changes in the Consumer Price Index. Requires the department to take certain actions regarding plans and applications submitted to the United States Environmental Protection Agency under 42 U.S.C. 7437.

Firearms. Prohibits a person from carrying a firearm in or near: (1) a chute; (2) polls; (3) certain areas where voters congregate or are likely to congregate; or (4) any room where ballots are being counted. Provides that the offense is a Class C misdemeanor, enhanced to a: (1) Class A misdemeanor if the person has a prior unrelated conviction for the offense; or (2) Level 6 felony if the firearm is pointed at another person. Specifies a defense and certain notice requirements. Prohibits other defenses. Changes the minimum age required to carry a handgun to 21 years of age. Makes it a Level 5 felony to possess a privately made firearm. Makes it a Level 5 felony to alter, obliterate, or remove certain marks of firearm identification or to possess a firearm on which those marks of identification have been altered, obliterated, or removed. Defines terms. Makes conforming amendments.

Federally qualified health center reimbursement. Requires the office of the secretary of family and social services to allow a federally qualified health center to elect for a separate reimbursement for pharmacy costs by removing pharmacy costs from the facility specific prospective payment system rate.

Education matters. Provides that, for each school year, a school corporation shall conduct at least: (1) 54,000 minutes of instructional time for students in grades 1 through 6; and (2) 64,800 minutes of instructional time for students in grades 7 through 12. (Current law requires the following: (1) That a school corporation conducts at least 180 student instructional days. (2) That a student instructional day in grades 1 through 6 consists of at least five hours of instructional time and a student instructional day in grades 7 through 12 consists of at least six hours of instructional time.) Defines "instructional day". Simplifies and makes corresponding changes to reducing tuition support if a school corporation fails to conduct the minimum number of instructional minutes during a school year. Makes corresponding changes, including corresponding changes to the school flex program and to the calculation for determining full-time equivalency for average daily membership. Provides that the plan to improve reading skills of students must include a review of the reading skills of students in grade 2 and implementation of remedial action before grade 3 for a student if the student's reading skills are determined to be below the standard. Requires a school to submit a report to the department of education (department) that includes certain information regarding students whose reading skills were determined to be below the standard on the grade 3 reading skills evaluation. Requires the department to annually submit a report to the governor and legislative council regarding the information.

Behavioral health and human services professionals. Specifies that statutes concerning behavioral health and human services professionals may not be construed to limit social work or clinical social work services performed by an employee or staff member of a community mental health center. Removes board approval to take a licensure examination as a requirement for a temporary permit to profess to be a clinical social worker, marriage and family therapist, mental health counselor, licensed addiction counselor, or licensed clinical addiction counselor.

Division of mental health and addiction matters. Prohibits the division of mental health and addiction (division) from requiring providers that are required to be accredited or certified by other entities to submit information to the division that would have been submitted to the accrediting or certifying body. Requires the division to establish a work group to discuss specified issues concerning audits and requires a report to be submitted before November 1, 2024.

340B drug program report. Requires an entity authorized to participate in the federal 340B Drug Pricing Program to annually report specified data to the Indiana department of health (department). Child caring institutions and group homes. Requires specified types of residential child care facilities to: (1) implement specified personnel policies, including with regard to: (A) minimum qualifications for specified employee classifications; and (B) maintenance of personnel records; (2) comply with specified restrictions on caseloads; (3) obtain specified health records, immunizations, and examinations for each child under the facility's care; and (4) follow specified processes in providing medical care for children in the facility's care, including with regard to administering psychotropic medications. Provides that certain individuals at least 18 years of age but less than 21 years of age are included in the definitions for "child", "child abuse or neglect", and "victim of child abuse or neglect". Makes conforming and technical changes.

Compensation for victims of violent crime. Amends definitions of emergency shelter care, motor vehicle, violent crime, and victim of a child sex crime. Changes out-of-pocket loss to out-of-pocket expenses. Provides that certain records obtained by the victim services division (division) of the criminal justice institute are to remain confidential. Provides that, where justice requires, the division may award compensation before an information or indictment is filed. Adds procedures for claim denial by the division. Provides that an award may not be made unless the claimant has incurred an out-of-pocket expense or loss of income that exceeds $100. Adds that the division may order the payment of compensation for reasonable, documented expenses that were incurred within 180 days of the violent crime. Provides that the director may extend the 180 days to two years for mental health counseling. Requires written verification of all losses and expenses requested before making an award. Adds procedures for application denial and appeals. Repeals the law relating to payment of compensable losses, hearings concerning the merits of an application, decisions by a hearing officer, the reduction of awards, and appealing the findings of a hearing officer.

Charter schools. Changes the chartering authority for a consolidated city. Beginning July 1, 2024, provides that only the charter board or the Indianapolis charter school board may grant chartering authority in a consolidated city. Provides that at least 45 days before a public hearing, an organizer must conduct a meeting with the school corporation where a charter school will be located to discuss certain information. Provides that not more than 30 days after meeting with an organizer, a school corporation must make a recommendation to the authorizer concerning the proposed charter school. Provides that a school corporation must be allowed to make public comments regarding a recommendation made to an authorizer at a public meeting.

Access to food program. Establishes the access to nutritious food program (program) under the administration of the Indiana housing and community development authority (IHCDA). Provides that the purpose of the program is to focus on: (1) distribution of fresh and nutritious food; and (2) education in food preparation and nutrition; in food deserts. Defines "food desert". Requires the IHCDA to convene an annual meeting to share best practices and information concerning effective programs and submit an annual report to the lieutenant governor and legislative council.

Packaging for low THC hemp extract. Provides that after June 30, 2024, the packaging of low THC hemp extract may not: (1) contain certain statements, artwork, or designs that could reasonably mislead any person to believe that the package contains anything other than low THC hemp extract; (2) bear the likeness or contain a cartoon-like characteristic of a real or fictional person, animal, or fruit that appeals to children; or (3) bear unauthorized trademarks, trade names, famous marks, or other identifying marks. Provides that after June 30, 2024, the packaging of low THC hemp extract shall: (1) be child proof; (2) be tamper evident; and (3) contain a disclosure statement.

Tax credit for beginning farmers. Provides an adjusted gross income tax credit for owners of agricultural assets who sell or rent agricultural assets to a qualified beginning farmer. Defines "qualified beginning farmer" and "agricultural assets" for purposes of the credit. Allows a taxpayer to apply to the Indiana economic development corporation (corporation) for approval and certification of the credit. Allows a beginning farmer to apply to the corporation for certification as a qualified beginning farmer. Provides that the credit is equal to: (1) the lesser of 5% of the sale price or fair market value of the agricultural asset or $32,000; or (2) 10% of the gross rental income in each of the first, second, and third years of the rental agreement, up to a maximum of $7,000 per year. Limits the total amount of tax credits that may be awarded in a state fiscal year to: (1) $5,000,000 in state fiscal year 2024-2025; and (2) $6,000,000 in state fiscal year 2025-2026, and each state fiscal year thereafter.
