Prohibition on copay accumulator adjustments. Provides that under certain circumstances, the administrator of the state employee health plan shall include any amount paid by a covered individual or another person on behalf of the covered individual for a prescription drug when calculating a covered individual's overall contribution to an out-of-pocket maximum or cost sharing requirement under the covered individual's state employee health plan. Provides that under certain circumstances, a pharmacy benefit manager shall include any amount paid by a covered individual or another person on behalf of the covered individual for a prescription drug when calculating a covered individual's overall contribution to an out-of-pocket maximum or cost sharing requirement under the covered individual's health plan. Provides that under certain circumstances, an insurer who issues a policy of accident and sickness insurance shall include any amount paid by an insured or another person on behalf of the insured for a prescription drug when calculating an insured's overall contribution to an out-of-pocket maximum or cost sharing requirement under the insured's policy of accident and sickness insurance. Provides that under certain circumstances, a health maintenance organization shall include any amount paid by an enrollee or another person on behalf of the enrollee for a prescription drug when calculating an enrollee's overall contribution to an out-of-pocket maximum or cost sharing requirement under the enrollee's individual or group contract.

Conversion to Class 3 city status. Provides that if the population of a second class city is reported by two consecutive federal decennial censuses (census) as having a population of less than 31,500, the city becomes a third class city on January 1: (1) of the calendar year following the next municipal election held after the most recent census; or (2) of the calendar year following the second municipal election held after the most recent census, if the effective date of the most recent census and the municipal election are in the same calendar year. Provides that if a city's population is less than 31,500 in the 2010 and 2020 censuses, the city becomes a third class city on January 1, 2027. Provides that the population of the second class city is calculated by subtracting the portion of the population of the city consisting of prison inmates from the population of the city reported by the federal decennial census.

County recorder's records perpetuation fund. Provides that certain fees collected by the county recorder are deposited in the county recorder's records perpetuation fund. Provides that a fee for recording a mortgage assumption is the same as the fee for recording a mortgage. Removes an expired provision. Makes stylistic changes.

Definition of sex and gender; birth certificates. Defines "sex" and "gender" for the purposes of the Indiana Code. States that the definition of "sex" and "gender" are meant to be synonymous in the Indiana Code unless specifically defined otherwise and is clarifying language. Requires the bureau of motor vehicles and the Indiana department of health (state department) to update the definition of sex used by the agencies. Requires the state department to: (1) identify birth certificates issued with a change in sex classification by court order; (2) change the sex on the birth certificate back to the originating sex and reissue the birth certificate; and (3) void the superseded document.

Instruction on human sexuality. Provides that, if a school provides instruction on human sexuality or sexually transmitted infections, the instruction must include instruction concerning consent to sexual activity and a presentation on human growth and development during pregnancy. Provides that a school maintained by a school corporation may not use curricular materials to provide instruction on human sexuality that have not been approved by the governing body of a school corporation. Requires a school corporation to include certain information concerning instruction on human sexuality in the written consent forms provided to a parent of a student or a student, if the student is an adult or an emancipated minor, before the student may receive instruction on human sexuality. Requires the governing body of a school corporation to publish a list of materials used in connection with instruction on human sexuality on the school's website and to include a link to the list of materials on electronically formatted written consent forms. Replaces references to "sexually transmitted diseases" with "sexually transmitted infections". Makes conforming changes.

Incarcerated women's maternal health fund. Establishes the Officer Breann Leath Memorial Prison Nursery (nursery) within a correctional facility determined by the commissioner of the department of correction (DOC). Specifies the criteria for operation, design, and implementation of the nursery and minimum standards that govern the nursery. Requires the DOC to provide an annual report to the legislative council concerning the nursery. Amends the statute requiring the DOC to adopt rules governing minimum standards for county jails to include the provision of menstrual discharge collection devices to inmates. Establishes the incarcerated women's maternal health fund to provide funds to support the nursery. Makes a continuing appropriation.

Requires the attorney general to establish a training course that members of a homeowners association board must complete.

Mental health and substance abuse coverage. Sets forth certain standards regarding reimbursement rates for providers of mental illness or substance abuse services. Provides that if a provider of health care services that provides both medical or surgical services and mental illness or substance abuse services is credentialed with an insurer or health maintenance organization for purposes of providing medical or surgical services, the provider must be considered automatically credentialed for purposes of providing mental illness or substance abuse services in instances under which the insurer provides coverage of mental illness or substance abuse services through a third party vendor.

Specifies that a license to practice as an advanced practice registered nurse expires on October 31 in each odd-numbered year. Makes conforming changes.

Higher education and workforce development matters. Establishes additional duties for the governor's workforce cabinet and requires the cabinet to perform certain duties jointly with other state agencies. Requires the Indiana management performance hub, in collaboration with the department of education (department) and commission for higher education (commission), to: (1) collect and compile certain student income data; and (2) compile into a data product on the department's and commission's websites certain data. Requires the secretary of education to establish a plan to develop a market driven stackable credentials and qualifications framework and submit the plan to the general assembly. Provides that the commission shall (instead of may) approve or disapprove certain branches, campuses, centers, new colleges, new schools, degrees, or programs. Provides that before the commission approves or disapproves a degree or program, a state educational institution shall provide, and the commission shall consider, certain information regarding the degree or program. Requires the commission to: (1) review each degree or program for approval or disapproval at least one time every 10 years; (2) outline a process for degree and program monitoring, improvement, suspension, and closure; (3) publish certain information; and (4) take official action regarding the approval or disapproval of certain requests within 90 days. Requires a state educational institution to approve for admission Indiana residents who meet certain requirements. Requires the board of trustees of a state educational institution to do the following: (1) When reviewing tenured faculty members, assess and review the staffing needs of the institution based on the branches, campuses, extension centers, colleges, schools, and degree and programs of the institution. (2) Submit to the commission any review of, renewal of, or amendment to the process or criteria regarding the tenured faculty member review. Requires the commission to promptly review the process and criteria and provide feedback to a board of trustees. Requires the commission to prepare and submit an annual report to the legislative council regarding certain student enrollment data. Adds duties for the department of workforce development.

Health care service provider employees. Requires a home health agency or personal services agency to run a criminal background check on certain employees on an annual basis. Increases the judgment against a home health agency or personal services agency when an employee who has been convicted of a crime prohibiting the individual's employment by the home health agency or personal services agency provides care that results in the death of a patient or client.
