An Act To Require Any Business That Makes An Automatic Renewal Offer For A Subscription Period Greater Than One Month To A Consumer In This State To Provide An Acknowledgement That Includes The Automatic Renewal Offer Terms, Cancellation Policy And Information Regarding How To Cancel; To Require Such Business Provide Notice To The Consumer, No Less Than Seven Days, But No More Than 21 Days Before The Automatic Renewal Date, Through Means Agreed To By The Consumer In The Acknowledgement, Of The Date The Plan Will Renew Along With Information Regarding How To Cancel; To Prohibit Any Such Business From Charging A Consumer For An Automatic Renewal Without First Having Complied With Such Acknowledgment Or Notice Requirement; To Provide That, If Such Business Charges A Consumer For An Automatic Renewal Without First Complying With Such Acknowledgment Or Notice Requirement, Then The Business Shall Refund The Consumer The Full Amount Charged; To Provide That Upon Cancellation By A Consumer Within 10 Days Following The Automatic Renewal Of A Subscription For A Period Greater Than One Month, The Subscription Amount Must Be Refunded Pro Rata Or In Full To The Consumer; And For Related Purposes.

An Act To Enact The Mississippi Consumer Data Protection Act; To Define Terms; To Provide The Scope Of Protection And Exemptions Of This Act; To Provide That This Act Applies To Certain Persons Conducting Business Within The State; To Exempt Certain Data From This Act; To Provide That A Consumer May Invoke The Consumer Rights Authorized Pursuant To This Act At Any Time By Submitting A Request To A Data Controller Through A Specified Procedure; To Require A Data Controller To Respond To A Consumer Without Undue Delay; To Require A Data Controller To Establish An Appeal Process For A Consumer To Appeal The Data Controller's Refusal To Take Action On A Request Within A Reasonable Period Of Time After The Consumer's Receipt Of The Decision; To Require A Data Controller To Adopt And Implement Reasonable Administrative, Technical, And Physical Data Security Practices To Protect The Confidentiality, Integrity, And Accessibility Of Personal Data; To Require The Data Controller To Provide Consumers With A Reasonably Accessible, Clear, And Meaningful Privacy Notice; To Provide That If A Controller Sells A Consumer's Personal Data To Third Parties Or Engages In Targeted Advertising, The Data Controller Must Provide Clear And Conspicuous Notice To A Consumer; To Require Data Processors To Assist Data Controllers In Duties Required By This Act; To Provide That The Obligations Imposed On A Data Controller Or Data Processor Under This Act Shall Not Restrict A Controller's Or Processor's Ability To Collect, Use, Or Retain Certain Data; To Provide That The Obligations Imposed On A Data Controller Or Data Processor Under This Act Shall Not Apply Where Compliance By The Data Controller Or Data Processor Would Violate An Evidentiary Privilege Under The Laws Of The State; To Provide That This Act Shall Not Require A Data Controller, Data Processor, Third Party, Or Consumer To Disclose Trade Secrets; To Provide That The Attorney General Shall Have Exclusive Authority To Enforce This Act; To Provide Civil Penalties For Violation Of This Act; And For Related Purposes.

An Act To Penalize Certain Entities That Knowingly Publish Or Distribute Obscene Material Or Material That Promotes Child Sexual Exploitation, Or Sell Child Sexual Exploitation Devices Or Images; To Define Terms; To Provide That Any Commercial Entity That Knowingly Publishes Or Distributes Obscene Material Or Material That Depicts, Describes, Or Promotes Child Sexual Exploitation, On The Internet May Be Held Civilly Liable; To Provide A Civil Penalty And Civil Liability For Any Person Who Knowingly Buys, Sells, Delivers, Or Distributes Any Child Sexual Exploitation Device Or Image Or Possesses Such Device Or Image With The Intent To Do So Or Possesses A Child Sexual Exploitation Device Or Image That Has Been So Bought, Sold, Delivered, Or Distributed; To Authorize The Attorney General To Seek Injunctive Relief Against A Commercial Entity That Violates The Provisions Of This Act; To Require The Attorney To Promulgate Rules And Regulations; To Provide Procedural Provisions For An Action Brought Under This Act; To Exempt Certain Entities From The Act; To Provide That The Act Shall Be Severable; And For Related Purposes.

An Act To Reenact Section 41-29-176, Mississippi Code Of 1972, Which Was Repealed By Operation Of Law On July 1, 2018; To Provide Administrative Forfeiture Procedures For Certain Seized Property Under The Uniform Controlled Substances Law That Has A Value Of Less Than Twenty Thousand Dollars; To Provide That If The Value Of Forfeited Property Does Not Exceed Ten Thousand Dollars, Substitute Notice Of Intention To Administratively Forfeit The Property May Be Made By Posting A Notice On An Official State Government Forfeiture Site For At Least Thirty Consecutive Days; To Provide That Such Site Shall Be Created And Maintained By The Mississippi Bureau Of Narcotics; To Authorize The Bureau To Charge A Reasonable Fee If Other Seizing Law Enforcement Agencies Choose To Utilize Such Site For Internet Publication; To Provide Certain Requirements For Such Notice Of Publication; To Authorize Any Person Claiming An Interest In Property Which Is The Subject Of A Notice To Send A Written Notice Of Contest To The Seizing Law Enforcement Agency; To Authorize The Seizing Law Enforcement Agency To File A Petition Within Thirty Days After Receipt Of Such Notice; To Require The District Attorney Or His Or Her Designee To Prepare A Written Declaration Of Forfeiture Of The Subject Property If No Written Notice Of Contest Is Timely Sent To The Seizing Law Enforcement Agency And A Seizure Warrant Was Properly Obtained; To Provide A Procedure For Use, Distribution Or Disposal Of Forfeited Property Where A Seizure Warrant Was Properly Obtained And No Written Notice Of Contest Was Timely Sent; And For Related Purposes.

An Act To Enact The Mississippi Immigration Enforcement Act Of 2025; To Impose A Fee On Certain Licensee Pursuant To The Mississippi Money Transmitters Act To Be Directed To The Department Of Revenue; The Department Of Revenue Shall Direct All Revenues Derived From This Fee Into The Illegal Immigration Enforcement Fund; To Create The Illegal Immigration Enforcement Fund As A Special Fund Within The State Treasury; To Set Forth The Purposes Of The Fund; To Create The Illegal Immigration Enforcement Unit Within The Department Of Public Safety; To Provide That The Purpose Of The Illegal Immigration Enforcement Unit Is To Enforce Immigration Laws As Authorized Pursuant To Federal Laws, Including Under Section 287(g) Of The Federal Immigration And Nationality Act, 8 Usc § 1357, And Pursuant To The Laws Of This State; To Provide For A Specific Appropriation To The Illegal Immigration Enforcement Unit; To Require Each Law Enforcement Agency Operating A County Detention Facility Must Enter Into A Written Agreement With The United States Immigration And Customs Enforcement To Participate In The Immigration Program Established Under Section 287(g) Of The Immigration And Nationality Act, 8 Usc § 1357 By A Certain Date; To Authorize The Governor To Remove From Office Any Sheriff Or Other Local Official Responsible For Operating A County Detention Facility For Neglect Or Failure To Perform The Duties Of The Office As Required By This Act; To Provide That A Governmental Entity May Not Execute, Amend, Or Renew A Contract With A Common Carrier Or Contracted Carrier If The Carrier Is Willfully Providing Any Service In Furtherance Of Transporting A Person Into The State Of Mississippi Knowing That The Person Is An Unauthorized Alien, Except To Facilitate The Detention, Removal Or Departure Of The Person From This State Or The United States; To Allow A Tax Credit Equal To The Amount Of All Money Transmission Fees Assessed Pursuant To Section 2 Of This Act And Paid By The Taxpayer During The Tax Year; And For Related Purposes.
