FOR AN ACT ENTITLED 
 
"An Act prohibiting certain transactions by or with foreign adversaries; and providing 1 
for an effective date." 2 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 3 
   * Section 1. AS 34 is amended by adding a new chapter to read: 4 
Chapter 87. Prohibition on Transactions by Foreign Adversaries. 5 
Sec. 34.87.010. Prohibition on transactions by foreign adversaries. (a) A 6 
foreign adversary may not 7 
(1)  buy, lease, or rent critical infrastructure, land used for agricultural 8 
production, or real property that has a direct line of sight to any part of a military 9 
installation in the state; or 10 
(2)  enter into a contract with a person that would result in the foreign 11 
adversary's control of critical infrastructure or land used for agricultural production in 12 
the state. 13 
(b) A foreign adversary that violates this section shall divest itself of its 14    33-LS0967\B

interest in critical infrastructure or land used for agricultural production in the state 1 
within one year, after which time the property may be sold at public auction by the 2 
municipality in which the critical infrastructure or land is located, or by the state if the 3 
critical infrastructure or land is located in the unorganized borough. 4 
(c)  The attorney general or the municipality where the critical infrastructure or 5 
land used for agricultural production is located may bring an action in the superior 6 
court to enjoin a person from violating the provisions of this section. 7 
Sec. 34.87.900. Definitions. In this chapter, 8 
(1)  "critical infrastructure" means systems and assets, whether physical 9 
or virtual, so vital to the United States that the incapacity or destruction of the systems 10 
and assets would have a debilitating effect on security, national economic security, 11 
national public health or safety, or any combination of those matters; 12 
(2)  "foreign adversary" means a citizen of, a corporation domiciled or 13 
headquartered in, or the government of the People's Republic of China, the Republic 14 
of Cuba, the Islamic Republic of Iran, the Democratic People's Republic of Korea, the 15 
Russian Federation, the Syrian Arab Republic, the Republic of Yemen, or the 16 
Bolivarian Republic of Venezuela or a corporation in which a citizen of the People's 17 
Republic of China, the Republic of Cuba, the Islamic Republic of Iran, the Democratic 18 
People's Republic of Korea, the Russian Federation, the Syrian Arab Republic, the 19 
Republic of Yemen, or the Bolivarian Republic of Venezuela has a controlling 20 
interest.  21 
   * Sec. 2. The uncodified law of the State of Alaska is amended by adding a new section to 22 
read: 23 
APPLICABILITY: CONTRACTS. AS 34.87.010 and 34.87.900, enacted by sec. 1 of 24 
this Act, applies to contracts entered into on or after the effective date of this Act.  25 
   * Sec. 3. This Act takes effect immediately under AS 01.10.070(c).  26
