8 SYNOPSIS:         This bill makes an appropriation of $389,327
9	from the Education Trust Fund to Lyman Ward
10	Military Academy in Camp Hill, Alabama for the
11	support and maintenance of the educational program
12	of the institution, for the fiscal year ending
13	September 30, 2023; provides that the appropriation
14	is subject to certain provisions of the Code of
15	Alabama 1975; requires an operations plan and an
16	audited financial statement prior to the release of
17	any funds; and requires an end of year report.

20	TO BE ENTITLED
21	AN ACT
22 
23	To make an appropriation of $389,327 from the
24 Education Trust Fund to Lyman Ward Military Academy in Camp
25 Hill, Alabama for the support and maintenance of the
26 educational program of the institution, for the fiscal year
27 ending September 30, 2023; to provide that the appropriation
Page 1 1 is subject to certain provisions of the Code of Alabama 1975;
2 to require an operations plan and an audited financial
3 statement prior to the release of any funds; and to require an
4 end of year report.
5 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
6	Section 1. There is hereby appropriated the sum of
7 $389,327 from the Education Trust Fund to Lyman Ward Military
8 Academy in Camp Hill, Alabama for the support and maintenance
9 of the educational program of the institution, for the fiscal
10 year ending September 30, 2023.  
11	Section 2. The above appropriation is made for the
12 support of public education in Alabama and for the support and
13 maintenance of the above program.  The appropriation shall be
14 subject to the provisions, terms, conditions, and limitations
15 of the Budget and Financial Control Act, Code of Alabama 1975,
16 Sections 41-4-80 et seq.; the provisions of The Budget
17 Management Act of 1976, Code of Alabama 1975, Sections 41-19-1
18 et seq.; and any other provisions of this act.
19	Section 3. (a) Prior to the release of any funds
20 appropriated under this act the following reports shall be
21 submitted:
22	(1) An operations plan for the fiscal year 2023,
23 including goals and measurable performance indicators, shall
24 be submitted to and approved by the Director of Finance, as
25 provided for state agencies in Code of Alabama 1975, Section
26 41-19-10.
Page 2 1	(2) An audited financial statement for all
2 operations during the fiscal year 2021.
3	(b) It is the intent that funds appropriated for
4 fiscal year 2023 shall be released by the Director of Finance
5 following receipt of the above reports.
6	(c) In addition, quarterly reports shall be made to
7 the Director of Finance relating actual expenditures and
8 accomplishments to planned expenditures and accomplishments.
9 An end of year performance report for the fiscal year 2023
10 shall be made to the Director of Finance stating the work
11 accomplished and the services provided and the costs of
12 accomplishing the work and providing the services, citing
13 meaningful measures of program effectiveness and costs, as is
14 required for state agencies in Code of Alabama 1975, Section
15 41-19-11.
16	(d) The Director of Finance shall forward a copy of
17 all required reports to the Legislative Council in a timely
18 manner.
19	Section 4. This act shall become effective October
20 1, 2022.
