11	AN ACT

13	Relating to Mobile County; to provide for the
14 assessment and collection of additional court costs in certain
15 criminal cases in circuit and district courts for the
16 creation, implementation, and continued administration of a
17 mental health diversionary program; and to provide for the
18 distribution of proceeds.
19 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20	Section 1. (a) In Mobile County, in addition to any
21 court costs and fees now or hereafter authorized in the
22 county, additional court costs in the amount of ten dollars
23 ($10) shall be assessed and collected as costs on each
24 criminal case, including traffic cases, filed in the circuit
25 court and district court, except those filed in the juvenile
26 or family court.
Page 1 1	(b) (1) The costs shall be collected as other costs
2 in cases are assessed and collected by the clerk of the court
3 and shall be paid by the clerk to the Mobile County
4 Commission. The county commission, in consultation with the
5 judge assigned to the mental health diversionary program,
6 shall distribute the proceeds of the court costs to the
7 circuit court and the district attorney for the creation,
8 implementation, and continuing administration of a mental
9 health diversionary program, to be known as the "mental health
10 court."
11	(2) The fees shall not be waived by any court unless
12 all other fees, assessments, costs, fines, and charges
13 associated with the case are waived.
14	Section 2. This act shall become effective on the
15 first day of the third month following its passage and
16 approval by the Governor, or its otherwise becoming law.
