13	Relating to Shelby County; to amend Section 23 of
14 Act 79-524, 1979 Regular Session (Acts 1979, p. 935), as last
15 amended by Act 2007-482, relating to the personnel board for
16 county law enforcement officers, to further provide for the
17 amount of proceeds the board may receive from the tax imposed
18 on beer or malt or brewed beverages to assure the operation of
19 the personnel system for the recruitment and retention of
20 employees of the sheriff's office.
21 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22	Section 1. Section 23 of Act 79-524, 1979 Regular
23 Session (Acts 1979, p. 935), as amended, is amended to read as
24 follows:
25	"Section 23. All expenses incurred in the
26 implementation of the provisions of this act shall be financed
27 from a special fund provided in the county treasury for such
Page 1 1 purposes, pursuant to the passage of an additional tax on the
2 sales of beer, malt, or brewed beverages in Shelby County at
3 the 1977 Regular Session of the Legislature. It is further
4 provided, however, that expenditures by the board in one year
5 shall not exceed one hundred fifty thousand dollars ($150,000)
6 two hundred seventy-five thousand dollars ($275,000) derived
7 from the proceeds of the tax. Any income derived from the
8 proceeds of the tax, which exceeds the actual expenditures of
9 the board for any year, shall be paid over to the county
10 general fund and shall be used exclusively by the Sheriff's
11 Department for law enforcement purposes in the county."
12	Section 2. This act shall become effective on the
13 first day of the third month following its passage and
14 approval by the Governor, or its otherwise becoming law.
