2 ENROLLED, An Act,
3 Relating to Shelby County; to amend Section 23 of
4 Act 79-524, 1979 Regular Session (Acts 1979, p. 935), as last
5 amended by Act 2007-482, relating to the personnel board for
6 county law enforcement officers, to further provide for the
7 amount of proceeds the board may receive from the tax imposed
8 on beer or malt or brewed beverages to assure the operation of
9 the personnel system for the recruitment and retention of
10 employees of the sheriff's office.
11 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
12 Section 1. Section 23 of Act 79-524, 1979 Regular
13 Session (Acts 1979, p. 935), as amended, is amended to read as
14 follows:
15 "Section 23. All expenses incurred in the
16 implementation of the provisions of this act shall be financed
17 from a special fund provided in the county treasury for such
18 purposes, pursuant to the passage of an additional tax on the
19 sales of beer, malt, or brewed beverages in Shelby County at
20 the 1977 Regular Session of the Legislature. It is further
21 provided, however, that expenditures by the board in one year
22 shall not exceed one hundred fifty thousand dollars ($150,000)
23 two hundred seventy-five thousand dollars ($275,000) derived
24 from the proceeds of the tax. Any income derived from the
25 proceeds of the tax, which exceeds the actual expenditures of

1 the board for any year, shall be paid over to the county
2 general fund and shall be used exclusively by the Sheriff's
3 Department for law enforcement purposes in the county."
4 Section 2. This act shall become effective on the
5 first day of the third month following its passage and
6 approval by the Governor, or its otherwise becoming law.
