11	AN ACT

13	Relating to Shelby County; to amend Section 6 of Act
14 93-664 of the 1993 Regular Session (Acts 1993, p. 1145), as
15 amended by Act 2015-344 of the 2015 Regular Session (Acts
16 2015, p. 1070), relating to the civil service system of the
17 county; to further provide for the unclassified service in the
18 office of the Property Tax Commissioner.
19 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
20	Section 1. Section 6 of Act 93-664 of the 1993
21 Regular Session (Acts 1993, p. 1145), as amended by Act
22 2015-344 of the 2015 Regular Session (Acts 2015, p. 1070), is
23 amended to read as follows:
24	"Section 6. At the time Shelby County becomes
25 subject to the provisions of this act, all employees and
26 appointees holding full-time positions in the classified
27 service of the county shall be granted permanent status in the
Page 1 1 classified service and designation as a regular employee as
2 herein defined. All employees employed in a position in the
3 classified service that have not completed their probationary
4 period shall be required to complete it before gaining the
5 designation as regular employees as defined herein. The
6 service shall be divided into two categories, as follows:
7	"(1) The Administrator of Probate and Recording
8 Services (Chief Clerk) and the Assistant to the Judge of
9 Probate in the Office of the Judge of Probate and the
10 Administrator, Chief Appraiser, Supervisor of Collections and
11 Assessments, and the Supervisor of Business Personal Property
12 in the Office of the Property Tax Commissioner shall be
13 exempted from the civil service system and the classified
14 services.
15	"(2) A classified service comprised of all employees
16 and appointees holding regular full-time permanent positions
17 in the service of the county. Employees occupying these
18 positions shall be deemed to be in the classified service
19 unless specifically exempted from the service in accordance
20 with this act.
21	"(3) The unclassified service shall include, but not
22 be limited to, the following:
23	"a. Officials elected by popular vote.
24	"b. The County Attorney, County Manager, and County
25 Engineer.
26	"c. Consultants and/or independent contractors to
27 the commission.
Page 2 1	"d. Individuals employed in positions which are
2 funded either partially or fully through federal, state, or
3 local grants.
4	"e. Guards performing security duties associated
5 with either courthouse security or inmate work details.
6	"f. Employees occupying the positions of project
7 director, secretary, computer operator, or any other positions
8 of the Drug Task Force under the supervision of the Sheriff of
9 Shelby County or an incorporated board.
10	"g. Part-time members of boards.
11	"h. Attorneys, physicians, surgeons, and dentists
12 who, with permission of the appointing authority of a
13 governing body, engage in outside similar employment.
14	"i. The Administrator, Chief Appraiser, Supervisor
15 of Collections and Assessments, and the Supervisor of Business
16 Personal Property for the Property Tax Commissioner; and any
17 employees or appointees paid through the discretionary fund of
18 the Property Tax Commissioner. Notwithstanding any other
19 provisions of this act or any other law to the contrary, the
20 Property Tax Commissioner may from time to time adopt job
21 descriptions and assign duties and responsibilities to the
22 unclassified positions in the office of the Property Tax
23 Commissioner as determined appropriate.
24	"j. Any employees or appointees paid through the
25 discretionary fund of the Property Tax Commissioner who
26 receive or received more than 50 percent of their total
27 compensation from such fund.
Page 3 1	"k. The Administrator of Probate and Recording
2 Services (Chief Clerk) and the Assistant to the Judge of
3 Probate. Any employees or appointees paid through the Index
4 Fund (a discretionary fund of the Judge of Probate) or paid
5 through the Mental Health Program Discretionary Fund of the
6 Judge of Probate established by Act 2013-259, who receive or
7 received more than 50 percent of their total county
8 compensation from one of the funds.
9	"l. The chief probation officer-juvenile court
10 service director appointed by the district court judge that is
11 designated as the judge of the juvenile court. The County
12 Manager may provide performance information to the district
13 court judge concerning the chief probation officer-juvenile
14 court services director. 
15	"m. Coroner and deputy coroner and any other
16 employees under the supervision of the coroner.
17	"n. Employees occupying positions recognized as
18 either part-time, temporary, students and interns, and
19 emergency.
20	"(4) All unclassified service positions in the
21 following departments shall be governed by the leave policies
22 and compensation schedule as outlined within this act: County
23 commission, Judge of Probate, Property Tax Commissioner.
24 Full-time employees in the unclassified service of the county
25 commission, the Office of Judge of Probate, and the Office of
26 Property Tax Commissioner shall receive benefits eligibility
27 as with the classified service. No board or appointing
Page 4 1 authority shall be authorized to designate an individual in
2 the unclassified service as a regular employee in the service
3 of the county."
4	Section 2. This act shall become effective on the
5 first day of the third month following its passage and
6 approval by the Governor, or its otherwise becoming law.
