2 ENROLLED, An Act,
3	Relating to Shelby County; to amend Section 6 of Act
4 93-664 of the 1993 Regular Session (Acts 1993, p. 1145), as
5 amended by Act 2015-344 of the 2015 Regular Session (Acts
6 2015, p. 1070), relating to the civil service system of the
7 county; to further provide for the unclassified service in the
8 office of the Property Tax Commissioner.
9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
10	Section 1. Section 6 of Act 93-664 of the 1993
11 Regular Session (Acts 1993, p. 1145), as amended by Act
12 2015-344 of the 2015 Regular Session (Acts 2015, p. 1070), is
13 amended to read as follows:
14	"Section 6. At the time Shelby County becomes
15 subject to the provisions of this act, all employees and
16 appointees holding full-time positions in the classified
17 service of the county shall be granted permanent status in the
18 classified service and designation as a regular employee as
19 herein defined. All employees employed in a position in the
20 classified service that have not completed their probationary
21 period shall be required to complete it before gaining the
22 designation as regular employees as defined herein. The
23 service shall be divided into two categories, as follows:
24	"(1) The Administrator of Probate and Recording
25 Services (Chief Clerk) and the Assistant to the Judge of

1 Probate in the Office of the Judge of Probate and the
2 Administrator, Chief Appraiser, Supervisor of Collections and
3 Assessments, and the Supervisor of Business Personal Property
4 in the Office of the Property Tax Commissioner shall be
5 exempted from the civil service system and the classified
6 services.
7	"(2) A classified service comprised of all employees
8 and appointees holding regular full-time permanent positions
9 in the service of the county. Employees occupying these
10 positions shall be deemed to be in the classified service
11 unless specifically exempted from the service in accordance
12 with this act.
13	"(3) The unclassified service shall include, but not
14 be limited to, the following:
15	"a. Officials elected by popular vote.
16	"b. The County Attorney, County Manager, and County
17 Engineer.
18	"c. Consultants and/or independent contractors to
19 the commission.
20	"d. Individuals employed in positions which are
21 funded either partially or fully through federal, state, or
22 local grants.
23	"e. Guards performing security duties associated
24 with either courthouse security or inmate work details.

1	"f. Employees occupying the positions of project
2 director, secretary, computer operator, or any other positions
3 of the Drug Task Force under the supervision of the Sheriff of
4 Shelby County or an incorporated board.
5	"g. Part-time members of boards.
6	"h. Attorneys, physicians, surgeons, and dentists
7 who, with permission of the appointing authority of a
8 governing body, engage in outside similar employment.
9	"i. The Administrator, Chief Appraiser, Supervisor
10 of Collections and Assessments, and the Supervisor of Business
11 Personal Property for the Property Tax Commissioner; and any
12 employees or appointees paid through the discretionary fund of
13 the Property Tax Commissioner. Notwithstanding any other
14 provisions of this act or any other law to the contrary, the
15 Property Tax Commissioner may from time to time adopt job
16 descriptions and assign duties and responsibilities to the
17 unclassified positions in the office of the Property Tax
18 Commissioner as determined appropriate.
19	"j. Any employees or appointees paid through the
20 discretionary fund of the Property Tax Commissioner who
21 receive or received more than 50 percent of their total
22 compensation from such fund.
23	"k. The Administrator of Probate and Recording
24 Services (Chief Clerk) and the Assistant to the Judge of
25 Probate. Any employees or appointees paid through the Index

1 Fund (a discretionary fund of the Judge of Probate) or paid
2 through the Mental Health Program Discretionary Fund of the
3 Judge of Probate established by Act 2013-259, who receive or
4 received more than 50 percent of their total county
5 compensation from one of the funds.
6	"l. The chief probation officer-juvenile court
7 service director appointed by the district court judge that is
8 designated as the judge of the juvenile court. The County
9 Manager may provide performance information to the district
10 court judge concerning the chief probation officer-juvenile
11 court services director. 
12	"m. Coroner and deputy coroner and any other
13 employees under the supervision of the coroner.
14	"n. Employees occupying positions recognized as
15 either part-time, temporary, students and interns, and
16 emergency.
17	"(4) All unclassified service positions in the
18 following departments shall be governed by the leave policies
19 and compensation schedule as outlined within this act: County
20 commission, Judge of Probate, Property Tax Commissioner.
21 Full-time employees in the unclassified service of the county
22 commission, the Office of Judge of Probate, and the Office of
23 Property Tax Commissioner shall receive benefits eligibility
24 as with the classified service. No board or appointing
25 authority shall be authorized to designate an individual in

1 the unclassified service as a regular employee in the service
2 of the county."
3	Section 2. This act shall become effective on the
4 first day of the third month following its passage and
5 approval by the Governor, or its otherwise becoming law.
