13 Relating to Choctaw County; authorizing the Choctaw
14 County Commission to levy an additional annual issuance fee
15 for motor vehicle tags; to provide for and the distribution of
16 proceeds to the Choctaw County Rescue Squad; and to provide
17 for an advisory referendum.
18 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
19 Section 1. This act shall only apply in Choctaw
20 County.
21 Section 2. For each motor vehicle as defined in
22 Section 40-12-240 of the Code of Alabama 1975, the Choctaw
23 County Commission may levy an additional annual issuance fee
24 of one dollar ($1) to be collected by the Choctaw County
25 Revenue Commissioner for the issuance and renewal of each
26 motor vehicle tag in the county. The proceeds collected from
27 the fee shall be deposited into the county general fund to be
Page 1 1 distributed to the Choctaw County Rescue Squad to be used for
2 the operation of the rescue squad.
3 Section 3. This act shall be subject to an advisory
4 referendum in the county. The notice of the election shall be
5 given by the judge of probate and the election shall be held,
6 conducted, and the results canvassed in the manner as other
7 county elections. The election shall be held in conjunction
8 with the general election in November 2022. The question shall
9 be, "Do you favor the adoption of Act No. ____, of the 20__
10 __________ Legislative Session of the Alabama Legislature
11 authorizing the Choctaw County Commission to levy an
12 additional one dollar ($1) issuance fee on the issuance and
13 renewal of motor vehicle tags with the proceeds distributed to
14 the Choctaw County Rescue Squad? Yes ( ) No ( )." The county
15 shall pay any costs and expenses not otherwise reimbursed by a
16 governmental agency which are incidental to the election. The
17 Judge of Probate of Choctaw County shall certify the results
18 of the election to the Choctaw County Commission.
19 Section 4. This act shall become effective
20 immediately following its passage and approval by the
21 Governor, or its otherwise becoming law.
