8 SYNOPSIS:         This bill would relate to any Class 5
9	municipality organized under the provisions of Act
10	71, 1977 Regular Session (Acts 1977, p. 78), as
11	amended, which provides for a council manager form
12	of government in certain municipalities having
13	certain populations and would provide further for
14	the compensation of the council members and mayor.

16	A BILL
17	TO BE ENTITLED
18	AN ACT
19 
20	Relating to any Class 5 municipality organized under
21 the provisions of Act 71, 1977 Regular Session (Acts 1977, p.
22 78), as amended, which provides for a council manager form of
23 government in certain municipalities having certain
24 populations; to provide further for the compensation of the
25 council members and mayor; and to repeal Act 2009-737 of the
26 2009 Regular Session (Acts 2009, p. 2201).
27 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Page 1 1	Section 1. This act shall apply only in a Class 5
2 municipality organized under the provisions of Act 71, 1977
3 Regular Session (Acts 1977, p. 78), as amended.
4	Section 2. (a) This section shall become effective
5 beginning the next term of office of the city council
6 following the effective date of this act.
7	(b) The members of the city council shall receive an
8 annual salary of twenty-eight thousand dollars ($28,000) per
9 year, in lieu of any and all salary, expense allowance, or
10 other compensation now provided by law.
11	(c)(1) The city council, by majority recorded roll
12 call vote of the entire elected members of the council
13 conducted not later than six months prior to the next
14 qualifying date for election to the council, may grant to each
15 member of the council an additional expense allowance, payable
16 in equal monthly installments from the general fund of the
17 municipality.
18	(2) Any expense allowance granted to the members of
19 the city council shall become salary effective upon the next
20 term of office following the approval of the expense
21 allowance.
22	(d) Notwithstanding any provision of this section or
23 any other provision of the law to the contrary, the total
24 annual compensation of any member of the city council may not
25 exceed the total annual compensation of the mayor.
26	Section 3. Effective beginning the next term of
27 office of the mayor following the effective date of this act,
Page 2 1 the mayor shall receive an annual salary of thirty-five
2 thousand ($35,000) dollars, in lieu of any and all salary,
3 expense allowance, or other compensation now provided by law.
4	Section 4. Act 2009-737 of the 2009 Regular Session
5 (Acts 2009, p. 2201), providing for the compensation of the
6 mayor and members of the city council of Class 5
7 municipalities incorporated under the provisions of Act 71,
8 1977 Regular Session (Acts 1977, p. 78), is repealed.
9	Section 5. This act shall become effective
10 immediately following its passage and approval by the
11 Governor, or its otherwise becoming law.
