1 HB430 2 218153-2 3 By Representative Sells (Constitutional Amendment) 4 RFD: Local Legislation 5 First Read: 01-MAR-22 Page 0 HB430 1 2 ENROLLED, An Act, 3 To propose and amendment to the Constitution of 4 Alabama of 1901, relating to Butler County, to prohibit any 5 municipality lying within the county from establishing a 6 separate city school system without the prior approval of a 7 majority of the qualified electors of the county voting at 8 a referendum election. 9 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 10 Section 1. The following amendment to the 11 Constitution of Alabama of 1901, is proposed and shall become 12 valid as a part of the Constitution when all requirements of 13 this act are fulfilled: 14 PROPOSED AMENDMENT 15 In Butler County, no municipality lying within the 16 county may establish a separate city school system after 17 January 1, 2022, without the prior approval of a majority of 18 the qualified electors of the county voting at 19 a referendum election held during a regularly scheduled 20 statewide general election in the county. 21 Upon ratification of this constitutional amendment 22 and contingent upon the ratification of the Constitution of 23 Alabama of 2022, the Code Commissioner shall number and place 24 this amendment as appropriate in the constitution based upon a 25 logical sequence and the particular subject or topic of the Page 1 HB430 1 amendment. In this amendment, the Code Commissioner may change 2 capitalization, spelling, and punctuation for the purpose of 3 style and uniformity; correct manifest grammatical, clerical, 4 and typographical errors; and correct incorrect 5 cross-references. When publishing the Constitution of Alabama 6 of 2022, the Code Commissioner may omit this instructional 7 paragraph. 8 Section 2. An election upon the proposed amendment 9 shall be held in accordance with Section 284.01 of the 10 Constitution of Alabama of 1901, now appearing as Section 11 284.01 of the Official Recompilation of the Constitution of 12 Alabama of 1901, as amended, and the election laws of this 13 state. 14 Section 3. The appropriate election official shall 15 assign a ballot number for the proposed constitutional 16 amendment on the election ballot and shall set forth the 17 following description of the substance or subject matter of 18 the proposed constitutional amendment: 19 "Relating to Butler County, proposing an amendment 20 to the Constitution of Alabama of 1901, to prohibit any 21 municipality lying within the county from forming a separate 22 city school system after January 1, 2022, without the prior 23 approval of a majority of the qualified electors of Butler 24 County voting at a referendum election. 25 "Proposed by Act _________" Page 2 HB430 1 This description shall be followed by the following 2 language: 3 "Yes ( ) No ( )."
