FISCAL NOTE

Senate Bill 54 as introduced amends the Alabama Memorial Preservation Act of 2017 to revise the penalty on entities that fail to get a waiver to rename, relocate, remove, alter or otherwise disturb public property until the property has been restored to its original condition from $25,000 per violation to $5,000 per day until the entity has taken full restorative action to comply with the provision of the Alabama Memorial Preservation Act. However, this bill provides that the Attorney General may stay the fines upon submission of supporting documentation that the restoration has begun. This bill could also increase the obligations of governmental entities that maintain architecturally significant buildings or memorial buildings by an undetermined amount to name any replacement building or erect a marker naming any resulting park or green space after the individual for whom the memorial building was named when one of those buildings is demolished.

Also, this bill could increase the obligations of the Alabama Historical Commission to design, construct and implement the placement of a life-size statue of civil rights leader John Lewis. This will increase the obligations and expenditures of the Historical Commission by an undetermined amount which could be offset by the amount of public or private gifts, grants, and donations, including in-kind services, and funds appropriated to the Commission by the Legislature if necessary.
