FN-YDX9N6-3 Page 1 FISCAL NOTE House Bill 168 Committee: Fiscal Responsibility and Economic Development Sponsor: Representative Kerry (Bubba) Underwood Analyst: Riley Aaron Date: 05/24/2023 House Bill 168 as passed the House of Representatives would: (1) increase the competitive bidding floor for public works contracts from $50,000, under law, to $100,000; (2) exclude purchases of heating and air conditioning units made through the State Purchasing Division of the Department of Finance; (3) provide further for certain emergency purchases; and (4) allow certain materials and equipment, currently exempt from competitive bidding, but part of a public works contract, to be excluded from public works bidding requirements. These provisions could increase or decrease the purchase price of goods and services procured by these government awarding authority, dependent on the difference in (1) the cost of products procured under the provisions of this bill and (2) the cost otherwise obtained under current law. This bill would also: (1) provide further for notice of completion of contracts by contractors; (2) remove newspaper advertisement requirements for certain public works contracts; and (3) allow bids for public works contracts to be submitted by electronic means.
