SYNOPSIS:
Under existing law, a retiree receiving an
Employees' Retirement System or Teachers' Retirement
System allowance may perform duties with an employer
participating in the system without suspension of the
retirement allowance, provided the person is not
employed in a permanent full-time capacity and the
compensation does not exceed $30,000 plus Consumer
Price Index adjustments after 2017.
This bill would provide further for the
compensation earned by retired law enforcement officers
working as school resource officers for local boards of
education.
A BILL
TO BE ENTITLED
AN ACT
Relating to the Teachers' Retirement System and the
Employees' Retirement System; to amend Section 16-1-44.1, Code
of Alabama 1975; to provide further for the compensation of
retired law enforcement officers providing services as school
resource officers for local boards of education.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. Section 16-1-44.1 of the Code of Alabama
1975, is amended to read as follows:
"ยง16-1-44.1
(a) As used in this section, the following terms have
the following meanings:
(1) RETIRED LAW ENFORCEMENT OFFICER. A person who was a
law enforcement officer and retired in good standing from a
federal, state, or local law enforcement agency with at least
20 years of law enforcement experience.
(2) SCHOOL RESOURCE OFFICER. A person who is certified
by the Alabama Peace Officers' Standards and Training
Commission as a law enforcement officer, whose certification
is in good standing, and who has the power of arrest.
(b) A local board of education may employ persons as
school security personnel or contract with a local chief of
police or sheriff to employ school resource officers. A local
board of education may allow any person employed by the board
as school security personnel or as a school resource officer
to carry a firearm while on duty if the employee satisfies all
of the following qualifications:
(1) He or she is certified by the Alabama Peace
Officers' Standards and Training Commission as a law
enforcement officer whose certification is in good standing or
he or she is a retired law enforcement officer.
(2) He or she has successfully completed active shooter
training approved by the Alabama State Law Enforcement Agency.
(3) He or she annually completes and passes the firearm
requalification required of law enforcement officers by the

Alabama Peace Officers' Standards and Training Commission.
(4) While on duty, he or she carries a non-lethal
weapon and is trained in the appropriate use of that
non-lethal weapon.
(c) The compensation paid to a retired law enforcement
officer employed by a local board of education as a school
resource officer for hours worked after regular school hours
for extracurricular activities shall be paid on a contractual
basis and shall not be included in the calculation of the
limits set forth by Sections 16-25-26(a) and 36-27-8.2(a).
(c)(d) Nothing in this section confers upon any
individual the power of arrest.
(d)(e) The State Department of Education shall adopt
any necessary rules to provide for the implementation of this
section including, but not limited to, rules providing
additional qualifications for employment as school security
personnel or school resource officers."
Section 2. This act shall become effective on the first
day of the third month following its passage and approval by
the Governor, or its otherwise becoming law.
