FN-8UC1HF-2 Page 1 FISCAL NOTE Senate Bill 309 Committee: County and Municipal GovernmentSponsor: Senator Clyde Chambliss Analyst: Riley Aaron Date: 05/16/2023 Senate Bill 309 as reported by the Committee on County and Municipal Government would require the professional services of architects, landscape architects, engineers, land surveyors, geoscientists, and other similar professions to: (1) undergo a qualification-based selection process when procured by certain state agencies and; (2) approval by the Division of Construction Management and the Governor for any professional services sought that are in excess of the fee schedule established by the Division. This could increase or decrease the purchase price of these services procured by various state entities by an undetermined amount depending on the difference in (1) the cost of products procured under this qualification-based selection process; (2) the fee schedule established by the Division; and (3) the cost otherwise obtained under current law. This bill would also increase the administrative obligations of the following governmental agencies and entities not subject to state procurement policies, as it relates to the procurement of professional services of architects, landscape architects, engineers, land surveyors, geoscientists, and interior designers, to adopt rules and policies pursuant to the provisions of this bill: (1) the Retirement Systems of Alabama; (2) all educational and eleemosynary institutions governed by a board of trustees or other similar governing body; (3) the Department of Mental Health; (4) the Alabama Department of Transportation; and (5) the Alabama State Port Authority.
