BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Section 1 of Act 2023-191 of the 2023 Regular Session, now appearing as Section 45-22-190, Code of Alabama 1975, is amended to read as follows: "ยง45-22-190 (a) The Cullman County Commission shall create the Cullman County Legislative Delegation Fund. (b) The fund shall be comprised of the following monies received by the county: (1) The additional three percent of TVA in-lieu-of-taxes payments received pursuant to Section 40-28-2. (2) The proceeds collected pursuant to Section 35-8B-5. (2)(3) Any other monies provided for by law. (d) The legislative delegation shall expend the monies on allowable public purposes at the discretion and direction of the legislative delegation , based on the proportion of the population each member of the delegation represents in the county. (e) All decisions concerning the Cullman County Legislative Delegation Fund shall be made by resolutions adopted by the members of the Cullman County Legislative Delegation. (f) Any funds allocated but not spent at the end of the fiscal year shall not be applied for any other purpose, but shall be carried forward and shall remain available year to year for expenditure as provided in this section. (g) The revenue and expenditures of the legislative delegation office shall be audited on an annual basis." Section 2.
