BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Sections 45-47-230 and 45-47-242.21, Code of Alabama 1975, are amended to read as follows: "§45-47-230 (a) The County Commission of Marion County is authorized and directed to pay the chief deputy sheriff, each deputy sheriff, and the sheriff's clerk an additional expense allowance of one hundred dollars ($100) per month payable from the general fund of the county. The expense allowance shall be in addition to all compensation or allowances heretofore payable to each such officer. (b) The Sheriff of Marion County shall be entitled to receive an expense allowance in the amount of five hundred dollars ($500) per month and each Each deputy sheriff of Marion County shall be entitled to receive an expense allowance of fifty dollars ($50) per month to be paid out of the county general fund. This expense allowance shall be in addition to any and all other compensation, salary, and expense allowances provided for by law. "§45-47-242.21 (a) The judge of probate is relieved of all duties and responsibilities relating to the assessment and collection of taxes, commissions, and issuance fees on motor vehicles. The revenue commissioner shall receive the commissions and fees currently allocated to the judge of probate for performing these functions, and those fees and commissions shall be remitted to the county general fund. Reporting and remitting the collections of those fees shall be made by the revenue commissioner or as otherwise required by law. (b) The Revenue Commissioner of Marion County shall perform all duties relating to the issuance of motor vehicle license plates in the county and shall perform all duties relating to the assessment and collection of ad valorem taxes, commissions, fees, or other charges imposed by law on motor vehicles, which have heretofore been performed jointly by the revenue commissioner and the judge of probate. (c) The Revenue Commissioner of Marion County shall be compensated an additional five thousand dollars ($5,000) per year, paid in equal monthly installments from the general fund of the county, for performing all of the duties relating to the assessments, collections, and issuance of motor vehicle license plates in Marion County. " Section 2. (a) Beginning on the effective date of this act, the Sheriff of Marion County shall receive an additional expense allowance in an amount that brings his or her total compensation to eighty thousand dollars ($80,000) per year to be paid out of the county general fund. The expense allowance shall be in addition to any and all other compensation, salary, or expense allowances provided by law. (b) Beginning with the next term of office, the expense allowance provided in subsection (a) shall be void, and the Sheriff of Marion County shall receive a total yearly salary of eighty thousand dollars ($80,000), which shall be in lieu of any other compensation, salary, or expense allowance provided by law for the sheriff for the performance of his or her official duties. Section 3. (a) Beginning on the effective date of this act, the Revenue Commissioner of Marion County shall receive an additional expense allowance in an amount that brings his or her total compensation to seventy-two thousand dollars ($72,000) per year to be paid out of the county general fund. The expense allowance shall be in addition to any and all other compensation, salary, or expense allowances provided by law. (b) Beginning with the next term of office, the expense allowance provided in subsection (a) shall be void, and the Revenue Commissioner of Marion County shall receive a total yearly salary of seventy-two thousand dollars ($72,000), which shall be in lieu of any other compensation, salary, or expense allowance provided by law for the revenue commissioner for the performance of his or her official duties. The compensation provided by Section 11-2A-3, Code of Alabama 1975, shall be considered to be included in the total yearly salary. Section 4. (a) Beginning on the effective date of this act, each member of the Marion County Commission shall receive 57 58 59 60 61 62 63 64 65 66 67 68 69 70 71 72 73 74 75 76 77 78 79 80 81 82 83 84 HB84 Enrolled Page 4 act, each member of the Marion County Commission shall receive an additional expense allowance in an amount that brings the total compensation of each member to sixty thousand dollars ($60,000) per year to be paid out of the county general fund. The expense allowance shall be in addition to any and all other compensation, salary, or expense allowances provided by law. (b) Beginning with the next term of office, the expense allowance provided in subsection (a) shall be void, and each member of the Marion County Commission shall receive a total yearly salary of sixty thousand dollars ($60,000), which shall be in lieu of any other compensation, salary, or expense allowance provided by law for the members for the performance of their official duties. Section 5. Section 45-47-70, Code of Alabama 1975, relating to expense allowances paid to members of the Marion County Commission, is repealed. Section 6.
