The bill would give the commission the sole authority to regulate maritime data for use in pilotage of ships and watercraft in Mobile Bay. A BILL TO BE ENTITLED AN ACT Relating to Class 2 municipalities; to amend Section 33-4A-13, Code of Alabama 1975, relating to rulemaking authority of the State Pilotage Commission; to regulate the usage of maritime data for use in pilotage of vessels. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Section 33-4A-13, Code of Alabama 1975, is amended to read as follows: "ยง33-4A-13 (a) The commission shall have the power and authority to may make all necessary rules and regulations regulating the piloting of ships and all watercrafts into and out of any harbor or seaport until berthed and moored at the docking facility in the Port of Mobile or until past the outer bar of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SB152 INTRODUCED Page 2 facility in the Port of Mobile or until past the outer bar of Mobile Bay upon departure . The commission shall have sole authority to permit or disallow use of maritime data collected for use in pilotage of vessels within the waters of the State of Alabama, unless the data is developed by an agency of the United States or approved by the commission. Maritime data produced by foreign states or by a foreign or domestic company must be expressly preapproved by the commission for any official use in pilotage. (b) The commission shall also have the power and authority to may require evidence of the physical and mental fitness of any active bar pilot at any time and to make adopt rules and regulations regarding the physical and mental capacity and fitness of the active bar pilots."
