This bill would also prohibit public K-12 schools in a Class 1 municipality from denying, or from being a member of any athletic association that denies, a student's participation in an athletic activity based on when he or she transferred to that school. A BILL TO BE ENTITLED AN ACT Relating to Class 1 municipalities; to require students who transfer from one public school in a Class 1 municipality to another to be enrolled in classes and eligible for participation in activities in the same manner as all other students; and to provide prohibitions relating to the denial of transfer student participation in athletic events. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. (a) This section shall only apply to Class 1 municipalities. (b) For the purposes of this section, the following terms have the following meanings: (1) ATHLETIC ACTIVITY. The same meaning as Section 16-30D-2, Code of Alabama 1975. (2) SCHOOL. A public K-12 school in a Class 1 municipality. (c)(1) Beginning with the 2025-2026 school year, any student who transfers from one school to another school shall be enrolled in classes and may participate in activities, including athletic activities, at the school to which he or she transferred in the same manner as all other students enrolled at that school. (2) No public K-12 school may deny, nor be a member of an athletic association that denies, student participation in or eligibility for an athletic activity at the school where the student is enrolled based on the date in which he or she transferred to or enrolled in that school.
