BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. (a) For the purpose of this section "illegal alien" means an individual not entitled to lawfully reside or work in the United States. (b) In all cases when it is shown that a criminal defendant, who is an illegal alien, has been convicted of a felony where the victim is a minor, he or she must be punished as follows: (1) On a conviction of a Class D felony, for a Class C felony. (2) On a conviction of a Class C felony, for a Class B felony. (3) On a conviction of a Class B felony, for a Class A felony. (c) In all cases when it is shown that a criminal defendant, who is an illegal alien, has been convicted of a misdemeanor offense where the victim is a minor, he or she shall be punished for a Class C felony.
