BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. The Judge of Probate of Choctaw County shall assess and collect an additional fee of ten dollars ($10) per instrument for all documents submitted for recording in Probate Court which are subject to a deed or mortgage tax. Section 2. The Choctaw County Probate Judge Fund is created in the county treasury. The funds generated from the additional recording fee levied by this act, and any interest earned thereon, shall be deposited into the Choctaw County Probate Judge Fund on a monthly basis and shall be used only by the judge of probate, in his or her sole discretion, for the operation of the office of the judge of probate, including, but not limited to, the digitalization of records; acquiring, updating, and replacing existing technology; and otherwise for the use of the office of the judge of probate for improvements of the recordkeeping in the office. Section 3.
