FN-PS19SER-2 Page 1 FISCAL NOTE House Bill 353 Committee: Finance and Taxation General FundSponsor: Representative Jim Hill Analyst: Peter Grogan Date: 04/23/2025 House Bill 353 as passed the House of Representatives would increase the obligations of the Office of Prosecution Services, funded by the State General Fund, by an estimated $331,000 annually by setting the salary of district attorneys (DAs) newly appointed or elected after October 1, 2021 to equal the salary of an incoming circuit court judge. These obligations would be effective beginning in either fiscal year 2029, or, if the constitutional amendment proposed by Senate Bill 226 is ratified, in fiscal year 2026. This bill would also provide for DAs to receive cost-of-living adjustments (COLAs) during their term of office, contingent on the ratification of the constitutional amendment proposed by House Bill 354, which would further increase the obligations of the State General Fund by an undetermined amount dependent on the amount of any such increases passed by the Legislature subsequent to passage of this bill. In addition, this bill codifies the current practice of the Alabama Administrative Office of the Courts of adjusting the salaries for justices and judges to include any COLAs provided by the Legislature. Finally, this bill provides that beginning with the next term of office beginning after October 1, 2025, the compensation of any elected official subject to a local law that sets their compensation, in whole or in part, on the salary of a circuit or district court judge shall be calculated using the salary amounts adjusted by this bill and that any adjustment based on longevity must be based on the respective elected official's time in office.
