The law further provides that the course of instruction and test may be given online. This bill would further implement the law by directing the board to adopt rules that recognize and enable vendors to conduct the program online. This bill provides that an employee who scores 70 percent or higher on the test has successfully completed the course. This bill further provides that if the board fails to adopt the rules within four months of the bill's enactment, the board will lose its authorization to operate retail liquor stores. This bill would also delete duplicative language and make nonsubstantive, technical revisions to update the existing code language to current style. A BILL TO BE ENTITLED 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SB14 INTRODUCED Page 2 TO BE ENTITLED AN ACT Relating to the Alcoholic Beverage Control Board; to amend Section 28-10-6, Code of Alabama 1975, to further provide for the Responsible Vendor Program by setting a passing grade for vendor employees who are tested on program course material; to implement vendor training and testing online by establishing a deadline for the Alcoholic Beverage Control Board to adopt rules for online training and testing; to revoke the authority of the board to operate any liquor stores for failure to adopt the rules; and to make nonsubstantive, technical revisions to update the existing code language to current style. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Section 28-10-6, Code of Alabama 1975, is amended to read as follows: "ยง28-10-6 (a) In order to qualify for certification, the vendor shall comply with the following requirements: (1) Provide a course of instruction for its employees approved by the board which shall include subjects dealing with alcoholic beverages as follows: a. Laws regarding the sale of alcoholic beverages for on-the-premises consumption and/or for off-the-premises sale for on-premises or off-premises consumption. b. Methods of recognizing and dealing with underage customers. c. The development of specific procedures Procedures for refusing sale to sell alcoholic beverages to underage customers, ; for assisting employees in dealing with underage customers;, and for dealing with handling intoxicated customers. (2) Require each employee who is authorized to sell alcoholic beverages in the normal course of his or her employment to complete the employee training course of instruction set out in subdivision (1) and to achieve a passing grade of 70 percent or higher on a test of the course subjects within 30 days of commencing employment. Responsible vendor training or testing may be conducted online by computer, in a classroom, or by live trainers. Any online training must include employee testing to pass. Nothing in this subdivision shall be construed to require an in-person test administrator or proctor. (3) Require all trained employees to attend additional meetings at least semiannually or such other schedule of meetingson another periodic basis as may be approved by the board, by rule, which meetings shall include the dissemination of existing and new information presentation of additional information covering the applicable subjects specified in this section and explainingan explanation of the vendor's policies and procedures relating to those subjects. (4) Maintain employment records of the training of its employees required by this section . (5) Post signs on the vendor's premises informing customers of the vendor's policy against selling alcoholic beverages to underaged persons underage customers. (b)(1) Responsible vendor training and testing may be conducted online by computer or in person by instructors. (2) Nothing in this section shall be construed to require the following: a. The presence of an administrator or proctor during testing, whether online or in person. b. Post-testing review of the subjects covered on the examination. (c)(1) No later than 120 days from the effective date of this act, the board shall certify rules consistent with the requirements of this act, including rules providing for both the presentation of the course of instruction and testing online by vendors. (2) If the board fails to certify rules by the 120th day from the effective date of this act as required under subdivision (1), the board may no longer operate any liquor store as defined in Section 28-3-1 ."
