SYNOPSIS:
This bill would require individuals in
possession of a firearm to secure the firearm in a
manner that a reasonable individual would know that an
unauthorized individual is not likely to gain access to
the firearm.
This bill would also provide a criminal penalty
for securing a firearm in violation of this
requirement.
A BILL
TO BE ENTITLED
AN ACT
Relating to firearms; to establish firearm storage
requirements; and to establish criminal penalties for
violations.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. (a) For the purposes of this section, the
following terms have the following meanings:
(1) FIREARM. The same meaning as provided in Section
13A-8-1, Code of Alabama 1975. 
(2) UNAUTHORIZED PERSON. Any individual whom a
possessor of a firearm has not authorized to possess the

possessor of a firearm has not authorized to possess the
firearm or any individual not legally permitted to possess a
particular firearm under state or federal law.
(b) An individual shall at all times secure a firearm
in his or her possession, control, care, or custody in a
manner and location where the individual knows, or reasonably
should know, that an unauthorized person is not likely to gain
access to the firearm.
(c) A violation of subsection (b) is a Class C felony.
(d) Neither of the following shall be construed to have
been stored in violation of subsection (b): 
(1) A firearm stored with a gun lock.
(2) A firearm carried on one's person. 
Section 2. This act shall become effective on October
1, 2025.
