Meeks 5 6 For An Act To Be Entitled 7 AN ACT CONCERNING AG E AND RESIDENCY REQU IREMENTS FOR 8 ATTENDING PUBLIC SCH OOLS; TO EXPAND THE NUMBER OF 9 INDIVIDUALS FOR WHOM PUBLIC SCHOOLS SHALL BE OPEN AND 10 FREE; AND FOR OTHER PURPOSES. 11 12 13 Subtitle 14 CONCERNING AGE AND RESIDENCY REQUIREMENTS 15 FOR ATTENDING PUBLIC SCHOOLS; AND TO 16 EXPAND THE NUMBER OF INDIVIDUALS FOR WHOM 17 PUBLIC SCHOOLS SHALL BE OPEN AND FREE. 18 19 20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21 22 SECTION 1. Arkansas Code § 6 -18-202(b)(1) and (2), concerning the 23 individuals for whom public schools of any school district in the State of 24 Arkansas shall be open and free, are amended to read as follows: 25 (b)(1) The public schools of any school district in this state shall 26 be open and free through completion of the secondary prog ram to all persons 27 in this state between five (5) and twenty -one (21) years of age whose: 28 (A) Whose parent, legal guardian, person having lawful 29 control of the person, or person standing in loco parentis resides within the 30 school district; and to all persons between those ages who 31 (B) Who have been legally transferred to the school 32 district for education purposes. 33 (2) For purposes of this section, a student may use the 34 residential address of a legal guardian, person having legal, lawful control 35 of the student under order of a court, or person standing in loco parentis 36 HB1030 2 12/6/2022 11:24:20 AM TNL017 only if the student: 1 (A) Student resides at the same residential address ; and 2 if the guardianship 3 (B)(i) Guardianship or other legal authority of the 4 student is not granted solely for educational needs or school attendance 5 purposes. 6 (ii) However, subdivision (b)(2)(B)(i) of this 7 section shall not apply to a host family of an international exchange student 8 placed by an international student exchange visitor placement orga nization 9 under the International Student Exchange Visitor Placement Organization 10 Registration Act, § 6 -18-1701 et seq. 11 12 SECTION 2. Arkansas Code § 6 -18-202(g), concerning age and residence 13 for attending public schools and students' ability to participate in the 14 Public School Choice Act of 2015, is amended to add an additional subsection 15 to read as follows: 16 (g) This section shall not be construed to restrict a student's 17 ability to participate: 18 (1) Participate in a tuition agreement with a nonresident school 19 district; or to officially 20 (2) Officially transfer to another school district pursuant to 21 the Public School Choice Act of 2015, § 6 -18-1901 et seq.; or 22 (3) Attend school as an international exchange student placed 23 with a host family by an int ernational student exchange visitor placement 24 organization under the International Student Exchange Visitor Placement 25 Organization Registration Act, § 6 -18-1701 et seq. 26 27 SECTION 3. Arkansas Code Title 6, Chapter 18, Subchapter 2, is amended 28 to add an additional section to read as follows: 29 6-18-234. Attendance of international exchange student — Required — 30 Definitions. 31 (a) As used in this section: 32 (1) "Host family" means the individual or family with whom an 33 international exchange student is placed by an international student exchange 34 visitor placement organization under the International Student Exchange 35 Visitor Placement Organization Registration Act, § 6 -18-1701 et seq.; and 36 HB1030 3 12/6/2022 11:24:20 AM TNL017 (2) "International exchange student" means a student who is 1 placed with a host family by an international student exchange visitor 2 placement organization under the International Student Exchange Visitor 3 Placement Organization Registration Act, § 6 -18-1701 et seq. 4 (b) A public school in the public school district in which a host 5 family resides shall admit for enrollment and attendance at the public school 6 an international exchange student who has been placed with the host family. 7 (c) A public school district that admits an international exchange 8 student may: 9 (1)(A) Upon his or her arrival, require the international 10 exchange student to submit to quarantine to prevent the spread of infectious 11 diseases as may be necessary. 12 (B) A quarantine required under subdivision (c)(1)(A) of 13 this section shall not exceed seven (7) days unless otherwise recommended by 14 the Department of Health or Centers for Disease Control and Prevention; and 15 (2) Expel or suspend the international exchange student from the 16 public school based on a: 17 (A) Violation of the school district's writte n student 18 discipline policies, as required under § 6 -18-507; or 19 (B) Danger that the international exchange student 20 presents to the students attending and individuals employed by the school 21 district. 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
