English 5 6 For An Act To Be Entitled 7 AN ACT TO AMEND THE ARKANSAS MILITARY CH ILD SCHOOL 8 TRANSITIONS ACT OF 2 021; TO AMEND FEDERA L CITATIONS 9 WITH REGARD TO THE D EFINITION OF "ACTIVE DUTY"; TO 10 REQUIRE A PUBLIC SCH OOL MILITARY FAMILY EDUCATION 11 COORDINATOR BE INCLU DED IN ESTABLISHING A PUBLIC 12 SCHOOL DISTRICT PARE NT AND FAMILY ENGAGE MENT PLAN; TO 13 AMEND THE QUORUM REQ UIREMENTS FOR THE AR KANSAS 14 COUNCIL FOR MILITARY CHILDREN; AND FOR OT HER 15 PURPOSES. 16 17 18 Subtitle 19 TO AMEND THE ARKANSAS MILITARY CHILD 20 SCHOOL TRANSITIONS ACT OF 2021. 21 22 23 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24 25 SECTION 1. Arkansas Code § 6-4-302, Article II, concerning the 26 definition of "active duty" used within the Interstate Compact on Educational 27 Opportunity for Military Children, is amended to read as follows: 28 A. “Active duty” means: full -time duty status in the active 29 uniformed service of the United States, including members of the National 30 Guard and Reserve on active duty orders pursuant to 10 U.S.C. Section 31 Chapters 1209 and 1211. 32 33 SECTION 2. Arkansas Code § 6 -28-104, concerning the definition of 34 "active duty" as it is used under the Arkansas Military Child School 35 Transitions Act of 2021, is amended to read as follows: 36 As Engrossed: S3/27/23 SB387 2 03-27-2023 10:01:21 TNL274 (2) “Active duty” means full -time duty status in the active, 1 uniformed services of the United States, including without limitation members 2 of the National Guard and reserve components of the uniformed services on 3 active duty orders under 10 U.S.C. §§ 10 U.S.C. Chapters 1209 and 1210 or 42 4 U.S.C. § 204, as they existed on January 1, 2021; 5 6 SECTION 3. Arkansas Code § 6 -28-116 is amended to read as follows: 7 6-28-116. New student reception programs — Military family education 8 coordinators. 9 A public school with twenty (20) or more children of military families 10 enrolled as students under this chapter or a public school district with at 11 least three thousand (3,000) enrolled public school students shall: 12 (1) Incorporate into the policies of the public school district 13 specific procedures that outline actions to take in suppor t of students who 14 are the children of military families who transition to and from the public 15 school district; and 16 (2)(A) Designate in each public school district a military 17 family education coordinator to serve as the primary point of contact for 18 each child of a military family and his or her parent or legal guardian. 19 (B) The public school military family education 20 coordinator shall have: 21 (i) Have specialized knowledge regarding the 22 educational needs of children of military families and the obs tacles that 23 children of military families face in obtaining an education ; and 24 (ii) Be included in the establishment and adoption 25 of a public school district's and public school's parent and family 26 engagement plan as required under § 6 -15-1702. 27 (C) The Division of Elementary and Secondary Education 28 shall supply relevant resources for the orientation and training of public 29 school military family education coordinators under this section. 30 31 SECTION 4. Arkansas Code § 6 -28-203(a)(6), concerning the in clusion of 32 the Executive Director of the Arkansas Activities Association on the Arkansas 33 Council for Military Children, is amended to read as follows: 34 (6) The Executive Director of the Arkansas Activities 35 Association, or his or her designee ; 36 As Engrossed: S3/27/23 SB387 3 03-27-2023 10:01:21 TNL274 1 SECTION 5. Arkansas Code § 6 -28-203, concerning the members serving on 2 the Arkansas Council for Military Children, is amended to add an additional 3 subsection to read as follows: 4 (c) The identification of a designee who shall serve in lieu of a 5 council member and with the same authority of the council member under this 6 section shall be provided to the council in writing. 7 8 SECTION 6. Arkansas Code § 6 -28-204(e), concerning the purpose and 9 duties of the Arkansas Council for Military Children, is amended to read as 10 follows: 11 (e)(1) A majority of all council members shall constitute a quorum at 12 council meetings. 13 (2) The absence of the Chair of the Senate Committee on 14 Education or the Chair of the House Committee on Education or designees from 15 each of the committees shall not count against a quorum. 16 17 /s/J.
