BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25

SECTION 1. Arkansas Code Title 14, Chapter 1, Subchapter 1, is amended 27
to add an additional section to read as follows: 28
14-1-108. Loan or financing agreement for the sale of a dog or cat — 29
Prohibition — Penalty — Definitions. 30
(a) As used in this section: 31
(1) "Legislative body" means the quorum court of a county or the 32
city council, board of directors, board of commissioners, or similar elected 33
governing body of a local government ; 34
(2) "Local government" means a county, a city of the first 35
class, a city of the second class, or an incorporated town; 36 SB528

(3) "Ordinance" means an ordinance, resolution, or other 1
appropriate legislative enactment of a legislative body that: 2
(A) Prohibits an individual from operating a business from 3
a residence; or 4
(B) Requires an individual to obtain approval before 5
operating a business from a residence; and 6
(4) "Person" means an individual or legal entity. 7
(b) A person shall not offer, ar range, broker, negotiate, place, find, 8
or service a loan or financing agreement for the sale of a dog or cat. 9
(c) This section does not prohibit a legislative body of a local 10
government from enacting and enforcing an ordinance that regulates the sale 11
of a dog or cat. 12
(d) A violation of this section is a Class A misdemeanor. 13
