Collins 5 6 7 For An Act To Be Entitled 8 AN ACT TO REPEAL PERFORMANCE -BASED INCENTIVE AWARDS 9 FOR PUBLIC SCHOOLS AND OPEN-ENROLLMENT PUBLIC CHARTER 10 SCHOOLS; AND FOR OTHER PURPOSES. 11 12 13 Subtitle 14 TO REPEAL PERFORMANCE -BASED INCENTIVE 15 AWARDS FOR PUBLIC SCHOOLS AND OPEN -16 ENROLLMENT PUBLIC CHARTER SCHOOLS. 17 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19 20 SECTION 1. Arkansas Code § 6 -15-2107 is amended to read as follows: 21 6-15-2107. Arkansas School Recognition Program. 22 (a) The General Assembly finds that there is a need for an incentive 23 program for outstanding schools. The General Assembly further finds that 24 performance-based incentives are commonplace in the private sector and should 25 be infused into the public sector as a reward for productivity. 26 (b)(a) The Arkansas School Recognition Program is created to provide 27 financial awards to public schools and open-enrollment public charter schools 28 that experience high student performance and those with high student academic 29 growth, which includes high school graduation rate comparisons for secondary 30 schools. 31 (c)(1)(A)(b)(1)(A) If funds are available, a public school or open-32 enrollment public charter school shall receive performance-based funding of: 33 (i) One hundred dollars ($100) per student who 34 attends the public school or open-enrollment public charter school if : 35 (a) The public school or public charter school 36 HB1022 2 11/20/2024 9:02:18 AM is in the top five percent (5%) of all public schools in Arkansas in student 1 performance under the criteria set forth by rule of the State Board of 2 Education; 3 (b) The the public school or open-enrollment 4 public charter school is in the top five percent (5%) of all public schools 5 in Arkansas in student academic growth under the criteria set forth by rule 6 of the state board State Board of Education ; or 7 (c) The public school or public charter school 8 meets the criteria established by the state board to be used in lieu of the 9 criteria set forth in subdivisions (c)(1)(A)(i)(a) and (b) of this section 10 to reward top-performing public schools; or 11 (ii) Fifty dollars ($50) ($50.00) per student who 12 attends the public school or open-enrollment public charter school if : 13 (a) The public school or public charter school 14 is in the top ten percent (10%) but below the top five percent (5%) of all 15 public schools in Arkansas in student performance under the criteria set 16 forth by rule of the state board; 17 (b) The the public school or open-enrollment 18 public charter school is in the top ten percent (10%) but below the top five 19 percent (5%) of all public schools and open-enrollment public charter schools 20 in Arkansas in student academic growth under the criteria set forth by rule 21 of the state board; or 22 (c) The public school or public charter school 23 meets the criteria established by the state board to be used in lieu of the 24 criteria set forth in subdivisions (c)(1)(A)(ii)(a) and (b) of this section 25 to reward high-performing public schools that do not meet the eligibility 26 criteria set forth in subdivision (c)(1)(A)(i) of this section . 27 (B) The rewards financial awards listed in subdivision 28 (c)(1)(A)(b)(1)(A) of this section: 29 (i) Shall begin after the 2012 -2013 state-mandated 30 assessments; and 31 (ii) Shall shall be based upon the results of state -32 mandated assessments. 33 (2) The Division of Elementary and Secondary Education may 34 disburse available performance-based funding appropriated for this section by 35 the General Assembly on a pro rata basis. 36 HB1022 3 11/20/2024 9:02:18 AM (d)(1) All eligible schools shall receive performance -based funding. 1 (2)(A)(c)(1) Funds shall be distributed under this section to 2 the public school's or open-enrollment public charter school's fiscal agent 3 and placed in the public school's or open-enrollment public charter school's 4 account and shall be used for purposes listed in subsection (e)(d) of this 5 section as determined by a committee , which shall include: 6 (i)(A) The principal; 7 (ii)(B) A teacher elected by the faculty; and 8 (iii)(C) A parent representative selected by the 9 local parent-teacher association or some other local parental involvement 10 group. 11 (B)(2) The committee shall make its determination under 12 subdivision (c)(1) of this section by December 15 of each applicable year. 13 (e)(d) School recognition awards under subdivision (c)(1) of this 14 section shall be used for the following: 15 (1) Nonrecurring bonuses to the faculty and staff; 16 (2) Nonrecurring expenditures for educational equipment or 17 materials to assist in maintaining and improving student performance; or 18 (3) Temporary personnel for the public school or open-enrollment 19 public charter school to assist in maintaining and improving student 20 performance. 21 (f)(e) School recognition awards under subdivision (c)(1) of this 22 section are exempt from §§ 6-17-119 and 6-20-412. 23 (g)(f) The General Assembly shall appropriate and fund provide 24 sufficient funds to implement this section. 25 26 27 28 29 30 31 32 33 34 35 36
