AN ACT TO REQUIRE REIMBURSEMENT FOR REMOTE ULTRASOUND 9 
PROCEDURES AND REMOTE FETAL NONSTRESS TESTS IN THE 10 
ARKANSAS MEDICAID PROGRAM; AND FOR OTHER PURPOSES. 11

ULTRASOUND PROCEDURES AND REMOTE FETAL 16 
NONSTRESS TESTS IN THE ARKANSAS MEDICAID 17 
PROGRAM. 18 
 19 
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20 
 21 
 SECTION 1.  Arkansas Code Title 20, Chapter 77, Subchapter 1, is 22 
amended to add an additional section to read as follows: 23 
 20-77-153.  Reimbursement for remote ultrasound procedures and remote 24 
fetal nonstress tests. 25 
 (a)(1)  The Arkansas Medicaid Program shall reimburse for remote 26 
ultrasound procedures and remote fetal nonstress tests utilizing established 27 
Current Procedural Terminology codes for remote ultrasound procedures and 28 
fetal nonstress tests when the patient is in a residence or other off	-site 29 
location from the healthcare provider of the patient and the same standard of 30 
care is met. 31 
 (2)  Subdivision (a)(1) of this section shall apply to the fee -32 
for-service categories of the program and any managed care plan within the 33 
program. 34 
 (b)  A remote ultrasound and remote fetal nonstress test shall be 35 
reimbursable when the healthcare provider uses digital technology that: 36    	HB1053

 (1)  Collects medical and other forms of health data from a 1 
patient and electronically transmits the information securely to a healthcare 2 
provider in a different location for interpretation and recommendation; 3 
 (2)  Is compliant with the Health Insurance Portability and 4 
Accountability Act of 1996, 42 U.S.C. § 1320d et seq., as it existed on 5 
January 1, 2025; and 6 
 (3)  Is approved by the United States Food and Drug 7 
Administration. 8 
 (c)  A remote fetal nonstress test shall be reimbursed under a Current 9 
Procedural Terminology code 5905 in the same manner as an in -person clinic 10 
fetal nonstress test with the place of service at home and shall use remote 11 
monitoring solutions that are approved by the United States Food and Drug 12 
Administration for on -label use for monitoring fetal heart rate, maternal 13 
heart rate, and uterine activity. 14 
 (d)  The Department of Human Services shall: 15 
 (1)  Apply for any federal waiver, Medicaid state plan 16 
amendments, or other authority necessary to implement this section; and 17 
 (2)  Adopt rules to implement this section. 18 
 19 
 SECTION 2.  DO NOT CODIFY.  Rules. 20 
 (a)  When adopting the initial rules required under this act, the 21 
Department of Human Services shall file the final rules with the Secretary of 22 
State for adoption under § 25 -15-204(f): 23 
 (1)  On or before January 1, 2026; or 24 
 (2)  If approval under § 10 -3-309 has not occurred by January 1, 25 
2026, as soon as practicable after approval under § 10 -3-309. 26 
 (b)  The department shall file the proposed rules with the Legislative 27 
Council under § 10-3-309(c) sufficiently in advance of January 1, 2026, so 28 
that the Legislative Council may consider the rules for approval before 29 
January 1, 2026. 30
