AN ACT CONCERNING THE INCARCERATION OF A VETERAN OF 9 
THE UNITED STATES ARMED FORCES; TO PROVIDE FOR 10 
NOTIFICATION TO THE ARKANSAS DEPARTMENT OF VETERANS 11 
AFFAIRS OF THE INCARCERATION OF A VETERAN; AND FOR 12 
OTHER PURPOSES. 13

VETERAN OF THE UNITED STATES ARMED 18 
FORCES; AND TO PROVIDE FOR NOTIFICATION 19 
TO THE ARKANSAS DEPARTMENT OF VETERANS 20 
AFFAIRS OF THE INCARCERATION OF A 21 
VETERAN. 22

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24 
 25 
 SECTION 1.  Arkansas Code Title 12, Chapter 29, Subchapter 1, is 26 
amended to add an additional section to read as follows: 27 
 12-29-121.  Notification required for incarceration of veteran of the 28 
United States Armed Forces. 29 
 (a)(1)  Within thirty (30) days of the initial incarceration of a 30 
veteran of the United States Armed Forces whose sentence of incarceration is 31 
sixty (60) days or more, the administrator of the correctional facility with 32 
custody of the veteran shall mail written notice of the veteran's 33 
incarceration to the Arkansas Department of Veterans Affairs. 34 
 (2)  At least sixty (60) days prior to the release from 35 
incarceration of a veteran of the United States Armed Forces whose sentence 36    	HB1077

of incarceration is sixty (60) days or more, the administrator of the 1 
correctional facility with custody of the veteran shall mail written notice 2 
of the veteran's release from incarceration to the Arkansas Department of 3 
Veterans Affairs.  4 
 (b)(1)  The Department of Corrections and the sheriff of each county 5 
shall inquire as a part of the intake procedure for each inmate whether the 6 
inmate is a veteran of the United States Armed Forces. 7 
 (2)  The Department of Corrections and the sheriff of each county 8 
shall develop procedures to ensure compliance with this section, including 9 
the use of a form designated for the notification of incarceration of a 10 
veteran by the Arkansas Department of Veterans Affairs. 11

 SECTION 2.  Arkansas Code Title 12, Chapter 41, Subchapter 1, is 13 
amended to add an additional section to read as follows: 14 
 12-41-111.  Notification required for incarceration of veteran of the 15 
United States Armed Forces. 16 
 (a)(1)  Within thirty (30) days of the initial incarceration of a 17 
veteran of the United States Armed Forces whose sentence of incarceration is 18 
sixty (60) days or more, the administrator of the correctional facility with 19 
custody of the veteran shall mail written notice of the veteran's 20 
incarceration to the Arkansas Department of Veterans Affairs. 21 
 (2)  At least sixty (60) days prior to the release from 22 
incarceration of a veteran of the United States Armed Forces whose sentence 23 
of incarceration is sixty (60) days or more, the administrator of the 24 
correctional facility with custody of the veteran shall mail written notice 25 
of the veteran's release from incarceration to the Arkansas Department of 26 
Veterans Affairs.  27 
 (b)(1)  The sheriff of each county and chief of police responsible for 28 
each city jail shall inquire as a part of the intake procedure for each 29 
inmate whether the inmate is a veteran of the United States Armed Forces. 30 
 (2)  The sheriff of each county and chief of police responsible 31 
for each city jail shall develop procedures to ensure compliance with this 32 
section, including the use of a form designated for the notification of 33 
incarceration of a veteran by the Arkansas Department of Veterans Affairs. 34
