BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

SECTION 1. Arkansas Code Title 20, Chapter 77, Subchapter 27, is 25
amended to add an additional section to read as follows: 26
20-77-2709. Independent assessments for home - and community-based 27
services. 28
(a) The Department of Human Services shall implement an abbreviated 29
independent assessment process, including without limitation a desk review, 30
for beneficiaries who have chronic, long -term conditions and who receive 31
home- and community-based services through enrollment in a risk -based 32
provider organization. 33
(b) The department shall apply for any federal waiver, Medicaid state 34
plan amendment, or other authorization necessary to implement this section. 35
