Penzo 6 7 For An Act To Be Entitled 8 AN ACT TO AMEND THE FULL PRACTICE AUTHORITY OF A 9 CERTIFIED NURSE MIDWIFE TO ALLOW ADMITTING 10 PRIVILEGES; AND FOR OTHER PURPOSES. 11 12 13 Subtitle 14 TO AMEND THE FULL PRACTICE AUTHORITY OF 15 A CERTIFIED NURSE MIDWIFE TO ALLOW 16 ADMITTING PRIVILEGES. 17 18 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19 20 SECTION 1. Arkansas Code § 17 -87-315(b), concerning the definition of 21 "full practice authority" relating to certified nurse midwives, is amended to 22 read as follows: 23 (b) As used in this section, “full practice authority” means the 24 authority of a healthcare professional to: 25 (1) Evaluate patients; 26 (2) Diagnose medical conditions; 27 (3) Order and interpret diagnostic tests; 28 (4) Initiate and manage treatment and care plans, including 29 appropriate comanagement or transfer of high -risk patients to other 30 healthcare professionals as needed; and 31 (5) Prescribe and administer drugs listed in Schedules III — V 32 without a collaborative practice agreement or supervision of another 33 healthcare professional when performing healthcare services ; 34 (6) Admit and discharge patients from a licensed hospital if 35 granted privileges; and 36 As Engrossed: H1/29/25 HB1181 2 01-29-2025 08:58:04 JMB110 (7) Complete, sign, and submit forms for a certificate of birth 1 or death certificate . 2 3 SECTION 2. Arkansas Code § 20 -18-401(b) and (c), concerning birth 4 registration generally, are amended to read as follows: 5 (b)(1) When a birth occurs in an institution or en route thereto, the 6 person in charge of the institution or his or her authorized designee shall 7 obtain the personal data, prepare the certificate, certify that the child was 8 born alive at the place, time, and date stated on the certificate either by 9 signature or in an approved electronic process, and file the certificate as 10 directed in subsection (a) of this section. 11 (2) The physician, certified nurse midwife, or other person in 12 attendance shall provide the medical information required by the certificate 13 within seventy-two (72) hours after the birth. 14 (c) When a birth occurs outside an institution: 15 (1) The certificate shall be prepared and filed by one (1) of 16 the following in the indicated order of priority: 17 (A) The physician or certified nurse midwife in attendance 18 at or immediately after the birth, or in the absence of such a person; 19 (B) Any other person in attendance at or immediately after 20 the birth, or in the absence of such a person; or 21 (C) The father, the mother, or in the absence of the 22 father and the inability of the mother, the person in charge of the premises 23 where the birth occurred; and 24 (2) The division shall determine what evidence may be required 25 to establish the fact of birth. 26 27 SECTION 3.
