CARE TECHNICIAN ACT. 15

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17 
 18 
 SECTION 1.  Arkansas Code Title 17, Chapter 87, is amended to add an 19 
additional subchapter to read as follows: 20 
Subchapter 9 — Certified Dialysis Patient Care Technician Act 21 
 22 
 17-87-901.  Title. 23 
 This subchapter shall be known and may be cited as the "Certified 24 
Dialysis Patient Care Technician Act". 25 
 26 
 17-87-902.  Purpose. 27 
 The purpose of this subchapter is to ensure the health, safety, and 28 
welfare of the public by providing for the accurate, cost -effective, and safe 29 
utilization of dialysis patient care technicians in the administration of 30 
hemodialysis. 31 
 32 
 17-87-903.  Definition. 33 
 As used in this subchapter, "dialysis patient care technician" means a 34 
person who meets the requirements of § 17 -87-905. 35

 17-87-904.  Tasks performed. 2 
 A dialysis patient care technician may administer hemodialysis, 3 
including administering associated medications and central venous catheter 4 
access and care, under the authority of a registered nurse licensed in this 5 
state who may delegate tasks based on nursing judgment to a dialysis patient 6 
care technician based on the dialysis patient care technician’s education, 7 
knowledge, training, and skill. 8 
 9 
 17-87-905.  Registration. 10 
 (a)  To register as a dialysis patient care technician, an individual 11 
shall: 12 
 (1)  Possess a high school diploma or a general educational 13 
development certificate; 14 
 (2)  Demonstrate that he or she is: 15 
 (A)  Employed as a dialysis patient care technician; or 16 
 (B)  Enrolled in a training course that follows national 17 
recommendations for dialysis patient care technicians and is conducted 18 
primarily in the work setting; 19 
 (3)(A)  Obtain national certification by successful passage of a 20 
certification examination within eighteen (18) months of becoming employed as 21 
a dialysis patient care technician. 22 
 (B)(i)  A dialysis patient care technician shall recertify 23 
national certification at intervals required by the organization providing 24 
the certification examination. 25 
 (ii)  The intervals required under subdivision 26 
(a)(3)(B)(i) of this section shall include no fewer than thirty (30) and no 27 
more than forty (40) patient contact hours since the previous certification 28 
or recertification; 29 
 (4)  Submit an application with the Arkansas State Board of 30 
Nursing; and 31 
 (5)  Pay the applicable fee as determined by the board. 32 
 (b)(1)  An applicant for registration as a dialysis patient care 33 
technician shall report to the board, in writing, any conviction for a felony 34 
or misdemeanor. 35 
 (2)  A conviction is not a disqualification for registration 36    	HB1183

under this section unless the conviction relates to the criminal offenses 1 
listed in § 17-3-102. 2 
 (c)(1)  An applicant or a dialysis patient care technician may report 3 
any pardon or setting aside of a conviction to the board. 4 
 (2)  If a pardon or setting aside has been obtained, the 5 
conviction for which the pardon or setting aside was obtained shall 	not be 6 
maintained on the Dialysis Patient Care Technician Registry created under § 7 
17-87-906. 8 
 (d)  If a person registered as a dialysis patient care technician 9 
becomes licensed as a registered nurse or licensed practical nurse, his or 10 
her registration as a dialysis patient care technician shall terminate as of 11 
the date of licensure as a registered nurse or licensed practical nurse. 12 
 13 
 17-87-906.  Dialysis Patient Care Technician Registry — Contents of 14 
registry. 15 
 (a)(1)  The Arkansas State Board of Nursing shall list each dialysis 16 
patient care technician registrant on a registry to be named the "Dialysis 17 
Patient Care Technician Registry". 18 
 (2)  A listing in the registry is valid for the term of the 19 
registration and upon renewal unless the listing is refused renewal or is 20 
removed. 21 
 (b)  The registry shall contain the following information on each 22 
person who is a registered dialysis patient care technician: 23 
 (1)  The individual’s full name; 24 
 (2)  Any conviction of a felony or misdemeanor reported to the 25 
board; 26 
 (3)  A certificate showing completion of a nationally recognized 27 
training program; and 28 
 (4)  A certificate of completion of a nationally commercially 29 
available dialysis patient care technician certification examination. 30

 17-87-907.  Construction. 32 
 This subchapter does not: 33 
 (1)  Require a dialysis patient care technician to register as a 34 
medication assistive person under § 17 -87-701 et seq.; or 35 
 (2)  Apply to a dialysis patient care technician who is working 36    	HB1183

directly with a physician licensed by the Arkansas State Medical Board. 1
