There 2 is hereby appropriated, to the Department of Finance and Administration - 3 Disbursing Officer, to be payable from the Miscellaneous Agencies Fund 4 Account, for grants for the Pregnancy Help Organizations for the fiscal year 5 ending June 30, 2026, the following: 6 7 ITEM FISCAL YEAR 8 NO. 2025-2026 9 (01) PREGNANCY HELP ORGANIZATION GRANTS $2,000,000 10 11 SECTION 38. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PREGNANCY 13 HELP ORGANIZATION GRANTS. 14 (a)(1) As used in this section, "pregnancy help organization" means a 15 nonprofit corporation or an organization exempt from federal income tax, 16 existing as of January 1, 2024, that: 17 (A) Seeks to provide a range of services to individuals facing an 18 unintended pregnancy with the intention of encouraging pregnant women to give 19 birth to their unborn children; 20 (B) Promotes infant and maternal wellness and/or reduces infant and 21 maternal mortality, by: 22 i) Providing nutritional information and/or nutritional counseling; 23 ii) Providing prenatal vitamins; 24 iii) Providing a list of prenatal medical care options; 25 iv) Providing social, emotional, and/or material support; or 26 v) Providing referrals for WIC and community -based nutritional services, 27 including but not limited to food banks, food pantries, and food distribution 28 centers; and 29 (C) Does not perform, prescribe, provide referrals for, or encourage 30 abortion or affiliate with any organization that performs, prescribes, 31 provides referrals for, or encourages abortion. 32 (2) As used in this section, a "pregnancy help organization" includes 33 without limitation: 34 (A) Organizations traditionally known as "crisis pregnancy organizations"; 35 (B) Maternity homes; 36 HB1202 16 01/22/2025 9:37:18 AM JAP008 (C) Adoption agencies; and 1 (D) Social services agencies that provide material support and other 2 assistance to individuals facing an unintended pregnancy to help those 3 individuals give birth to their unborn children. 4 (b)(1) The Department of Finance and Administration shall create a grant 5 program to provide funding to pregnancy help organizations. 6 (2) Grant funds shall be disbursed directly to the pregnancy help 7 organizations from the Department of Finance and Administration. 8 (c)(1) The department shall promulgate rules to implement the disbursement of 9 the grant moneys from the Pregnancy Help Organization Grant Sub -Fund in the 10 Miscellaneous Agencies Fund Account. 11 (2) The rules shall include: 12 (A) A requirement that the entity requesting the grant monies submit a 13 plan describing how the entity will spend the grant moneys; and 14 (B) A statement that the funds shall not be disbursed all at once, but 15 in increments in accordance with the plan described in subdivision (c)(2)(A) 16 of this section. 17 (d) The provisions of this section shall be in effect only from July 1, 2024 18 2025, through June 30, 2025 2026. 19 20 SECTION 39. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 22 PROCEDURES - APPROPRIATION – INFRASTRUCTURE INVESTMENT & JOBS ACT OF 2021 . 23 (i) All appropriation and expenditures for funding received for the 24 Infrastructure Investment & Jobs Act of 2021 shall be expended using the 25 Infrastructure Investment & Jobs Act of 2021 appropriation sections as 26 authorized in this Act. 27 (ii) Any state agency, constitutional office, or institution shall request 28 a transfer of appropriation, as provided in the Infrastructure Investment & 29 Jobs Act of 2021 appropriation sections of this Act, from the Chief Fiscal 30 Officer of the State, stating clearly the amount requested, purpose and any 31 additional information requested by the Chief Fiscal Officer of the State. 32 (iii) After reviewing a request, the Chief Fiscal Officer of the State may 33 deny, modify or approve the request based on the estimated amount of 34 appropriation needed and currently available, purpose, estimated funding 35 available and preferred spending priority. Upon approval or modification of a 36 HB1202 17 01/22/2025 9:37:18 AM JAP008 request by the Chief Fiscal Officer of the State and after meeting the 1 requirements of subsection (iv) herein, the Department of Finance and 2 Administration shall establish the transfer of appropriation on the books of 3 the Department of Finance and Administration and the State Auditor, in 4 compliance with the applicable classifications of appropriations as 5 enumerated in Arkansas Code 19 -4-521 through 19-4-525. 6 (iv) Any request approved as authorized in subsection (iii) herein, 7 including requests that establish a new commitment item or new appropriation 8 shall require prior approval by the Legislative Council or the Joint Budget 9 Committee during a regular session, fiscal session, or extraordinary session 10 of the General Assembly. 11 (v) Any Oversight and/or Steering Committee charged with overseeing 12 disbursement of funds and appropriation from funds received from the 13 Infrastructure Investment & Jobs Act of 2021 appropriation sections of this 14 Act shall coordinate with the Department of Finance and Administration as 15 needed to facilitate the approval requirements herein in a timely manner. 16 (vi) Any appropriation approved in the Infrastructure Investment & Jobs Act 17 of 2021 by the General Assembly shall only be used for: 18 1) The purpose and amount of planned expenditures as submitted for 19 approval to the General Assembly and, 20 2) In the event that expenditures or obligations do not fully expend 21 approved appropriation authority as authorized in this section, the excess 22 appropriation may not be utilized for any additional expenditures other than 23 the amount and purpose as submitted to and approved by the General Assembly. 24 (vii) The Chief Fiscal Officer of the State shall submit a monthly report 25 to the Legislative Council or the Joint Budget Committee during a regular 26 session, fiscal session, or extraordinary session of the General Assembly or 27 to a designated subcommittee listing all Infrastructure Investment & Jobs Act 28 of 2021 beginning balance of funds received, each appropriation approved as 29 authorized in subsection (v) herein with the date the appropriation is 30 established, state entity, purpose, amount, funding distributed, and 31 remaining balance. 32 (viii) Determining the maximum amount of appropriation each fiscal year is 33 the prerogative of the General Assembly. This is usually accomplished by 34 delineating such maximums in the appropriation act(s). Further, the General 35 Assembly has determined that a state agency, constitutional office, or 36 HB1202 18 01/22/2025 9:37:18 AM JAP008 institution may operate more efficiently if some flexibility is provided to 1 the state agency, constitutional office, or institution authorizing broad 2 powers under this section. Therefore, it is both necessary and appropriate 3 that the General Assembly maintain oversight by requiring prior approval of 4 the Legislative Council or Joint Budget Committee as provided by this 5 section. The requirement of approval by the Legislative Council or Joint 6 Budget Committee is not a severable part of this section. If the requirement 7 for approval by the Legislative Council or Joint Budget Committee is ruled 8 unconstitutional by a court of competent jurisdiction, this entire section is 9 void. 10 11 SECTION 40. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 13 PROCEDURES - APPROPRIATION – AMERICAN RESCUE PLAN ACT OF 2021. (i) All 14 appropriation and expenditures for funding received for the American Rescue 15 Plan Act of 2021 shall be expended using the American Rescue Plan Act of 2021 16 Appropriation Sections as authorized in this Act. 17 (ii) Any state agency, constitutional office, or institution shall request 18 a transfer of appropriation, as provided in the American Rescue Plan Act of 19 2021 Appropriation Sections of this Act, from the Chief Fiscal Officer of the 20 State, stating clearly the amount requested, purpose and any additional 21 information requested by the Chief Fiscal Officer of the State. 22 (iii) After reviewing a request, the Chief Fiscal Officer of the State may 23 deny, modify or approve the request based on the estimated amount of 24 appropriation needed and currently available, purpose, estimated funding 25 available and preferred spending priority. Upon approval or modification of a 26 request by the Chief Fiscal Officer of the State and after meeting the 27 requirements of subsection (iv) herein, the Department of Finance and 28 Administration shall establish the transfer of appropriation on the books of 29 the Department of Finance and Administration and the State Auditor, in 30 compliance with the applicable classifications of appropriations as 31 enumerated in Arkansas Code 19 -4-521 through 19-4-525. 32 (iv) Any request approved as authorized in subsection (iii) herein, 33 including requests that establish a new commitment item or new appropriation 34 shall require prior approval by the Legislative Council during the extended 35 recess, beginning on May 1, 2021, of the 2021 Regular Session or during the 36 HB1202 19 01/22/2025 9:37:18 AM JAP008 interim, or the Joint Budget Committee during a regular session, fiscal 1 session, or extraordinary session of the General Assembly. 2 (v) Any Oversight and/or Steering Committee charged with overseeing 3 disbursement of funds and appropriation from funds received from the American 4 Rescue Plan Act of 2021 Appropriation Sections of this Act shall coordinate 5 with the Department of Finance and Administration as needed to facilitate the 6 approval requirements herein in a timely manner. 7 (vi) Any appropriation approved in the American Rescue Plan of 2021 by the 8 General Assembly shall only be used for: 9 (1) The purpose and amount of planned expenditures as submitted for 10 approval to the General Assembly and, 11 (2) In the event that expenditures or obligations do not fully expend 12 approved appropriation authority as authorized in this section, the excess 13 appropriation may not be utilized for any additional expenditures other than 14 the amount and purpose as submitted to and approved by the General Assembly. 15 (vii) It is the intent of the General Assembly that funds received from the 16 American Rescue Plan of 2021 that are discretionary or are not required to be 17 spent for a different general or specific purpose may be considered to be 18 utilized to pay off existing debt service. The parameters for the selection 19 of debt service payments may consider the highest interest rate owed and with 20 priority given to the payment of Big River Steel General Obligations bonds 21 and GARVEE Department of Transportation bonds. 22 (viii) The Chief Fiscal Officer of the State shall submit a monthly report 23 to the Legislative Council during the extended recess, beginning on May 1, 24 2021, of the 2021 Regular Session or during the interim, or the Joint Budget 25 Committee during a regular session, fiscal session, or extraordinary session 26 of the General Assembly or to a designated subcommittee listing all American 27 Rescue Plan Act of 2021 beginning balance of funds received, each 28 appropriation approved as authorized in subsection (v) herein with the date 29 the appropriation is established, state entity, purpose, amount, funding 30 distributed, and remaining balance. 31 (ix) Determining the maximum amount of appropriation each fiscal year is 32 the prerogative of the General Assembly. This is usually accomplished by 33 delineating such maximums in the appropriation act(s). SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 12 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 13 PROCEDURES - APPROPRIATION – C.A.R.E.S. (i) In the event that sufficient 14 appropriation is not provided by the General Assembly, any state agency, 15 constitutional office, or institution may request a transfer of 16 appropriation, as provided in the C.A.R.E.S. Appropriation Section of this 17 Act, from the Chief Fiscal Officer of the State, stating clearly the amount 18 requested, purpose and any additional information requested by the Chief 19 Fiscal Officer of the State. 20 (ii) After reviewing a request, the Chief Fiscal Officer of the State may deny, 21 modify or approve the request based on the estimated amount of appropriation 22 needed and currently available, purpose, estimated funding available and 23 preferred spending priority. Upon approval or modification of a request by the 24 Chief Fiscal Officer of the State and after meeting the requirements of 25 subsection (iii) herein, the Department of Finance and Administration shall 26 establish the transfer of appropriation on the books of the Department of 27 Finance and Administration and the State Auditor, in compliance with the 28 applicable classifications of appropriations as enumerated in Arkansas Code 19 -29 4-521 through 19-4-525. 30 (iii) Any request approved as authorized in subsection (ii) herein, including 31 requests that establish a new commitment item or new appropriation shall 32 require prior approval by the Arkansas Legislative Council or if meeting in 33 Regular or Fiscal Session the Joint Budget Committee. 34 (iv) Determining the maximum amount of appropriation each fiscal year is the 35 prerogative of the General Assembly. This is usually accomplished by delineating 36 HB1202 21 01/22/2025 9:37:18 AM JAP008 such maximums in the appropriation act(s). Further, the General Assembly has 1 determined that a state agency, constitutional office, or institution may 2 operate more efficiently if some flexibility is provided to the state agency, 3 constitutional office, or institution authorizing broad powers under this 4 section. Therefore, it is both necessary and appropriate that the General 5 Assembly maintain oversight by requiring prior approval of the Legislative 6 Council or Joint Budget Committee as provided by this section. The requirement 7 of approval by the Legislative Council or Joint Budget Committee is not a 8 severable part of this section. If the requirement or approval by the 9 Legislative Council or Joint Budget Committee is ruled unconstitutional by a 10 court of competent jurisdiction, this entire section is void. 11 The provisions of this section shall be in effect from the date of passage 12 through June 30, 2025 2026. 13 14 SECTION 42. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 16 CLASSIFICATION AND USE OF APPROPRIATIONS. The appropriations authorized in 17 the Marketing and Redistribution Section, hereof which are transferred to the 18 various agencies, as authorized in the Transfer Provision - Marketing and 19 Redistribution Section hereof, are to be used for the maintenance and general 20 operation of the benefiting agency and shall only be expended under the 21 provisions cited in Arkansas Code § 19 -4-522, the same being the General 22 Accounting and Budgetary Procedures Law of Arkansas. Provided, however, no 23 appropriation authorized herein shall be expended for Conference and Travel 24 Expenses or Professional Fees and Services. 25 The provisions of this section shall be in effect only from July 1, 2024 26 2025 through June 30, 2025 2026. 27 28 SECTION 43. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 29 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 30 PROVISION - MARKETING AND REDISTRIBUTION. The Department of Finance and 31 Administration shall, upon transfer to the agencies or institutions fund or 32 fund account of the proceeds derived from disposal of property by the 33 Marketing and Redistribution division for the benefit of various agencies, 34 transfer appropriation, as provided in the Marketing and Redistribution 35 Section, hereof in such amount as funds are deposited into the Property Sales 36 HB1202 22 01/22/2025 9:37:18 AM JAP008 Holding Fund and transferred therefrom for the benefit of such agencies. 1 The provisions of this section shall be in effect only from July 1, 2024 2 2025 through June 30, 2025 2026. 3 4 SECTION 44. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 5 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 6 RESTRICTIONS - MISCELLANEOUS TRANSFERS. Nothing in this Act is to be 7 construed as an authority to transfer a like amount of current general 8 revenues to fund appropriations provided for in the Miscellaneous Transfers 9 Section of this Act. 10 The provisions of this section shall be in effect only from July 1, 2024 11 2025 through June 30, 2025 2026. 12 13 SECTION 45. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 14 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 15 RESTRICTIONS - TRANSFER PROVISIONS. The Department of Finance and 16 Administration shall transfer appropriation as provided in the Refund to 17 Expenditures line item of the Miscellaneous Transfers Section, hereof in such 18 amounts as funds are deposited into the State Treasury or financial 19 institutions for proceeds received from insurance policies for casualty 20 losses, overpayment of obligations, overpayment of salaries, over -allocation 21 of federal assistance, maturity or redemption of investments, and subrogation 22 payments received for workers' compensation claims paid, for the benefit of 23 various state agencies. Provided, however, that the Chief Fiscal Officer of 24 the State is hereby authorized to promulgate such rules, regulations, 25 procedures, and guidelines as he or she may deem necessary and proper in 26 order to carry out the provisions of this Act. 27 The provisions of this section shall be in effect only from July 1, 2024 28 2025 through June 30, 2025 2026. 29 30 SECTION 46. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 31 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 32 PROCEDURES - PERSONAL SERVICES OVERTIME. In the event that there is not 33 sufficient appropriation provided for by the General Assembly for overtime 34 compensation pursuant to Arkansas Code § 19 -4-1612 and related personal 35 services matching for any state agency for the period ending June 30, 2025 36 HB1202 23 01/22/2025 9:37:18 AM JAP008 2026, said agency shall request a transfer from appropriations provided for 1 Overtime in the Miscellaneous Transfers Section, herein, from the Chief 2 Fiscal Officer of the State, stating clearly the amount required. Upon 3 approval of the Chief Fiscal Officer of the State, and after seeking prior 4 review by the Arkansas Legislative Council or Joint Budget Committee, the 5 State Auditor shall be notified as to the amount and the purposes for which 6 said appropriation is to be made. The appropriation shall be established 7 upon the books of the Department of Finance and Administration and the State 8 Auditor. Provided, further, that if desired, said appropriation shall be 9 supplemental to those regularly appropriated for such purposes by the General 10 Assembly for that agency. 11 The provisions of this section shall be in effect only from July 1, 2024 12 2025 through June 30, 2025 2026. 13 14 SECTION 47. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 16 CLASSIFICATION AND USE OF APPROPRIATIONS - REFUND TO EXPENDITURES. The 17 appropriations authorized for Refund to Expenditures in the Miscellaneous 18 Transfers Section, hereof which are transferred to the various agencies as 19 authorized by the RESTRICTIONS - MISCELLANEOUS TRANSFERS and the RESTRICTIONS 20 - TRANSFER POSITIONS Sections hereof are to be used for the same purposes and 21 shall be expended under the same provisions as cited in Arkansas Code §§ 19 -22 4-501 through 19-4-527, the same being the General Accounting and Budgetary 23 Procedures Law of Arkansas, or its successor. 24 The provisions of this section shall be in effect only from July 1, 2024 25 2025 through June 30, 2025 2026. 26 27 SECTION 48. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 28 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 29 PROCEDURES - CASH FUNDS. In the event that the appropriation is not provided 30 by the General Assembly for Cash Fund expenditures for any state agency, 31 pursuant to Arkansas Code § 19 -4-801 et seq., said agency shall request a 32 transfer of appropriation from the Chief Fiscal Officer of the State, stating 33 clearly the amount required. Upon approval of the Chief Fiscal Officer of 34 the State, and after seeking prior review by the Arkansas Legislative Council 35 or Joint Budget Committee, said cash fund appropriations shall be established 36 HB1202 24 01/22/2025 9:37:18 AM JAP008 upon the books of the Department of Finance and Administration, provided 1 further, that upon request of the state agency and with the approval of the 2 Chief Fiscal Officer of the State, the requested appropriations may be 3 established upon the books of the Department of Finance and Administration in 4 compliance with the applicable classifications of appropriations as 5 enumerated in Arkansas Code §§ 19 -4-521 through 19-4-527. 6 The provisions of this section shall be in effect only from July 1, 2024 7 2025 through June 30, 2025 2026. 8 9 SECTION 49. SALARIES. 24 No provisions as provided in the Various State Agencies - Cash Section herein 25 shall be interpreted as the authority to create or establish new positions in 26 addition to the positions established in the agency's Appropriation Act. In 27 addition, salaries paid from appropriations transferred herein shall be 28 subject to the provision of the Regular Salaries Procedures and Restrictions 29 Act. 30 The provisions of this section shall be in effect only from July 1, 2024 31 2025 through June 30, 2025 2026. 32 33 SECTION 51. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 34 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 35 PROCEDURES - PERSONAL SERVICES AND REGULAR SALARIES . In the event that the 36 HB1202 25 01/22/2025 9:37:18 AM JAP008 Chief Fiscal Officer of the State determines that the General Assembly has 1 not provided sufficient appropriation for the payment of Personal Services 2 for any office of an elected Constitutional Officer, including the Bureau of 3 Legislative Research, Division of Legislative Audit or the Judicial 4 Department, any state agency, office, board, commission, institution or 5 institution of higher education due to the enactment of this Act or any other 6 Act approved by the General Assembly which raises the compensation level or 7 required benefit matching costs of state employees, the agency, office, 8 board, commission, institution of higher education or other institution may 9 request a transfer from the appropriation provided herein from the Chief 10 Fiscal Officer of the State. Such request shall clearly state the amount 11 required, the fund or fund account from which the employees are currently 12 being paid, and such other information as may be required by the Chief Fiscal 13 Officer of the State that he or she deems necessary to make a decision 14 regarding the request. Upon the approval of the Chief Fiscal Officer of the 15 State, and upon review by the Performance Evaluation and Expenditure Review 16 Subcommittee of the Arkansas Legislative Council or Joint Budget Committee or 17 upon processing the request for elected Constitutional Officers and their 18 employees by the Chief Fiscal Officer of the State, the State Auditor shall 19 be notified as to the amount and the purposes for which said appropriation is 20 to be made. In the event that appropriation for the payment of Personal 21 Services is not sufficient for the last payroll of the fiscal year, the Chief 22 Fiscal Officer of the State may approve any transfers on an emergency basis 23 and provide a report to the Performance Evaluation and Expenditure Review 24 Subcommittee of the Arkansas Legislative Council or Joint Budget Committee. 25 The appropriation shall then be added to the proper account on the books of 26 the Department of Finance and Administration and the State Auditor payable 27 from the fund or fund account from which the employees of the state agency, 28 office, board, commission, institution of higher education or other 29 institution are authorized to be paid by law. Such appropriation transfers 30 shall be limited to Regular Salaries or Personal Services Matching or both. 31 The provisions of this section shall be in effect only from July 1, 2024 32 2025 through June 30, 2025 2026. 33 34 SECTION 52. Funding of compensation increases provided by 1 the General Assembly in the fiscal year ending June 30, 2025 2026, and 2 funding for the appropriation transfers authorized by the TRANSFER PROCEDURES 3 - PERSONAL SERVICES AND REGULAR SALARIES Section of this Act for those state 4 agencies, offices, boards, commissions, institutions and state institutions 5 of higher education which are supported in whole or in part from general 6 revenues shall, if required, be provided for by a transfer from the 7 Performance Fund to the proper fund or fund account and in such amounts as 8 may be determined by the Chief Fiscal Officer of the State and upon review by 9 the Performance Evaluation and Expenditure Review Subcommittee of the 10 Arkansas Legislative Council or Joint Budget Committee. The state agencies, 11 offices, boards, commissions, institutions and state institutions of higher 12 education shall, in addition to the funds provided in this section for 13 Personal Services from the Performance Fund, make available any funding 14 generated from its salary savings for such purposes as provided for herein, 15 from the funds or fund accounts as prescribed by law. 16 The provisions of this section shall be in effect only from July 1, 2024 17 2025 through June 30, 2025 2026. 18 19 SECTION 53. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 20 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. PUBLIC 21 DEFENDER. The appropriation provided in the Public Defender Reimbursement 22 line item of the Miscellaneous Grants and Expenses Section herein shall be 23 expended only for the purpose of reimbursing the Public Defender of Pulaski 24 County to provide defense for the mentally ill. 25 The provisions of this section shall be in effect only from July 1, 2024 26 2025 through June 30, 2025 2026. 27 28 SECTION 54. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 29 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. SHERIFFS' 30 ASSOCIATION. A lump sum monthly installment of at least one -twelfth (1/12) 31 of the annual allocation provided for in the Arkansas Sheriffs' Association 32 Section of this Act, or so much thereof as may be made available, shall be 33 provided to the Arkansas Sheriffs' Association to be used exclusively for the 34 establishment and operation of crime prevention and alcohol and drug abuse 35 programs and for a grant to the Arkansas Sheriffs' Association to study ways 36 HB1202 27 01/22/2025 9:37:18 AM JAP008 to improve the administration of sheriffs' offices and developing and 1 improving education programs designed for sheriffs' offices in Arkansas. 2 The provisions of this section shall be in effect only from July 1, 2024 3 2025 through June 30, 2025 2026. 4 5 SECTION 55. In the event that the fund 8 balance in the Administration of Justice Fund is inadequate to fund the 9 monthly allocation to State Agencies, the funds will be distributed as 10 follows: 11 (a) The available revenue and remaining State Administration of Justice 12 Fund balance shall be distributed first to fully fund the monthly allocations 13 found in the ALLOCATION RESTRICTIONS Section of this Act for: 14 (1) the Administrative Office of the Courts to fund the State Central 15 Services Fund for Trial Court Administrators, 16 (2) the District Judges Association for the District Court Coordinator, 17 and 18 (3) Administrative Office of the Courts to fund State Central Services 19 Fund for Court Reporters. 20 (b) The total funds remaining in the State Administration of Justice Fund 21 after the monthly distribution is made under subdivision (a) of this section 22 shall be distributed to the remaining state programs and state agencies 23 listed in the ALLOCATION RESTRICTIONS Section of this Act but not listed in 24 subdivision (a) of this section shall be funded in the percentage of the 25 total funds available in the Administration of Justice Fund; that is if less 26 than 100% of the total monthly allocation is available for distribution, 27 monthly allocations for the remaining agencies will be funded at an equal 28 percentage consistent with the remaining available funds, provided that any 29 of the allocations listed in the ALLOCATION RESTRICTIONS Section that have 30 been fully pledged prior to January 1, 2001 to the repayment of a bond issue 31 or bond issues shall not be reduced below the amount listed in the ALLOCATION 32 RESTRICTIONS Section of this Act. The Secretary of the Department of Finance and Administration 15 is authorized to transfer Appropriation and Funding between State’s 16 Contributions line items authorized in the State's Contributions Section. 17 Any unexpended balances in funds provided for State’s Contributions in this 18 Act remaining June 30, 2024 2025, shall be carried forward during the fiscal 19 year ending June 30, 2025 2026. 20 The provisions of this section shall be in effect only from July 1, 2024 21 2025 through June 30, 2025 2026. 22 23 SECTION 62. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 24 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 25 PROCEDURES - PERSONAL SERVICES STIPENDS. If there is not sufficient 26 appropriation, from funds deposited in the State Treasury or Cash Accounts of 27 an agency, for personal services, or personal services matching for any state 28 agency for the period ending June 30, 2025 2026, for State agencies that 29 process payroll through the Arkansas Administrative Statewide Information 30 System for federal and state tax reporting as necessary to comply with the 31 payment of stipends under United States Internal Revenue Code (IRC), 2001 -32 Code-Vol, Sec 3401 and Treasury Regulations §31.3401(c) -1(a) and §1.1402(c)-33 2(b), and others which govern the reporting of income and payment of 34 withholding and matching taxes for personal services, the agency shall 35 request a transfer from appropriation provided for Personal Services and 36 HB1202 33 01/22/2025 9:37:18 AM JAP008 Personal Services Matching in the appropriation for Various State Agencies - 1 U.S. IRC and Treasury Regulations herein, from the Chief Fiscal Officer of 2 the State, stating clearly the amounts required for each item. Upon approval 3 of the Chief Fiscal Officer of the State, the State Auditor shall be notified 4 as to the amount and the purposes for which the appropriation is to be made 5 and such appropriation as needed shall be established upon the books of the 6 Department of Finance and Administration and the State Auditor. Provided, 7 however, that in the event the total amount of transfer requested in any 8 fiscal year exceeds Ten Thousand Dollars ($10,000), the Chief Fiscal Officer 9 of the State shall seek prior review by the Arkansas Legislative Council or 10 Joint Budget Committee before the transfer shall be made. 11 The provisions of this section shall be in effect only from July 1, 2024 12 2025 through June 30, 2025 2026. 13 14 SECTION 63. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. POSITION 16 ESTABLISHMENT. The Chief Fiscal Officer of the State shall have the authority 17 to establish such positions as necessary for State agencies to process 18 payroll through the Arkansas Administrative Statewide Information System for 19 federal and state tax reporting purposes as necessary to comply with the 20 United States Internal Revenue Code (IRC), 2001 -Code-Vol, Sec 3401 and 21 Treasury Regulations §31.3401(c) -1(a) and §1.1402(c)-2(b), and others which 22 govern the reporting of income and payment of withholding and matching taxes 23 for personal services. The positions established shall not be considered as 24 part of the total number of authorized positions for an agency and shall only 25 be considered as placeholders for payments to individuals who are board or 26 commission members or elected officials of the State that do not otherwise 27 receive salaries or wages as defined in Arkansas Code § 19 -4-521 for their 28 personal services. Further, none of the positions established under this 29 section shall imply eligibility for state retirement or state health 30 insurance benefits. The establishment of such positions shall not exceed 250 31 positions in any fiscal year. 32 The provisions of this section shall be in effect only from July 1, 2024 33 2025 through June 30, 2025 2026. 34 35 SECTION 64. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 36 HB1202 34 01/22/2025 9:37:18 AM JAP008 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 1 AUTHORIZED - ARKANSAS CHILDREN'S HOSPITAL. The Arkansas Children's Hospital 2 may request the Chief Fiscal Officer of the State to transfer funds made 3 available for the following by this Act sums not to exceed $1,000,000 for the 4 Arkansas Children's Hospital Burn Center, $700,000 for the Children's 5 Hospital Payments, $600,000 for the Reproductive Health Monitoring, and 6 $233,600 for the Intensive Care Nursery each fiscal year from the 7 Miscellaneous Agencies Fund Account to the Department of Human Services 8 Grants Fund Account. The transferred funds shall be used to match federal 9 funds used for supplemental Medicaid payments to Arkansas Children's 10 Hospital. 11 The Arkansas Children's Hospital may also request the Chief Fiscal Officer 12 of the State to transfer the sum not to exceed $1,000,000 each fiscal year 13 from the Miscellaneous Agencies Fund Account from funds made available by 14 this Act for the Intensive Care Nursery to the Department of Human Services 15 Grants Fund Account. The transferred funds shall be used to match federal 16 Medicaid funds for cost -based reimbursement for helicopter patient transport. 17 The provisions of this section shall be in effect only from July 1, 2024 18 2025 through June 30, 2025 2026. 19 20 SECTION 65. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 21 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 22 INNOVATION AND PROJECT DEVELOPMENT FUND TRANSFERS. The Department of 23 Transformation & Shared Services - Division of Information Systems is a cost 24 recovery agency subject to the requirements of the United States Office of 25 Management and Budget Circular A -87 Cost Principles for State, Local and 26 Indian Tribal Government (A -87) and Cost Principles for Developing Cost 27 Allocation Plans and Indirect Cost Rates for Agreements with the Federal 28 Government Implementation Guide for the Office of Management and Budget 29 Circular A-87 (ASMBC-10). To comply with these federal rules, it is necessary 30 to establish an Innovation and Project Development appropriation and general 31 revenue fund account within the Department of Finance and Administration - 32 Disbursing Officer for the Department of Transformation & Shared Services - 33 Division of Information Systems. This fund shall be used for state enterprise 34 innovation projects that would enhance the technology operations of the State 35 that cannot be cost allocated to federal programs. Fund transfers 2 may be made from the General Revenue Fund Account, upon the approval of the 3 Chief Fiscal Officer of the State and prior review of the Arkansas 4 Legislative Council or Joint Budget Committee, to reimburse the Department of 5 Transformation & Shared Services - Division of Information Systems for the 6 amounts billed. 7 The provisions of this section shall be in effect only from July 1, 2024 8 2025 through June 30, 2025 2026. 9 10 SECTION 66. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 12 PROCEDURES – PERSONAL SERVICES EXTRA HELP. In the event that there is not 13 sufficient appropriation provided for by the General Assembly for payment of 14 personal services related to Extra Help for any state agency for the period 15 ending June 30, 2025 2026, said agency may request a transfer from 16 appropriations provided for Personal Services Extra Help in the Miscellaneous 17 Transfers Section herein, from the Chief Fiscal Officer of the State, stating 18 clearly the amount required. Upon approval of the Chief Fiscal Officer of 19 the State, and after seeking prior review by the Arkansas Legislative Council 20 or Joint Budget Committee, the State Auditor shall be notified as to the 21 amount and the purposes for which said appropriation is to be made. The 22 appropriation shall then be established upon the books of the Department of 23 Finance and Administration and the State Auditor. Provided further, that if 24 desired, said appropriation shall be supplemental to those regularly 25 appropriated for such purposes by the General Assembly for the agency. 26 The provisions of this section shall be in effect only from July 1, 2024 27 2025 through June 30, 2025 2026. 28 29 SECTION 67. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 30 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 31 INTRASTATE METRO PLANNING GRANTS. As referenced in Section 9 of Act 637 of 32 1995, the authorized funding for Intrastate Metro Planning Grants that are 33 evenly distributed among planning and development districts under the 34 Miscellaneous Grants and Expenses Section of this Act shall include the West 35 Central Arkansas Economic Development District. 36 HB1202 36 01/22/2025 9:37:18 AM JAP008 The provisions of this section shall be in effect only from July 1, 2024 1 2025 through June 30, 2025 2026. 2 3 SECTION 68. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 4 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 5 USAGE AUTHORIZED. The Arkansas Children’s Hospital President and C.E.O. may 6 request the Department of Human Services -Division of Medical Services to 7 retain in the Department of Human Services Grant Fund account an amount not 8 to exceed $1,000,000 for funds made available by the act to be used to match 9 federal funds used for supplemental Medicaid payments to Arkansas Children’s 10 Hospital. 11 The provisions of this section shall be in effect only from July 1, 2024 12 2025 through June 30, 2025 2026. 13 14 SECTION 69. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 15 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 16 PROCEDURES - MEDICAL MARIJUANA IMPLEMENTATION AND REGULATION. In the event 17 that sufficient appropriation is not provided by the General Assembly for 18 expenditures resulting from the implementation and regulation of the Arkansas 19 Medical Marijuana Amendment of 2016 for any state agency, pursuant to 20 Arkansas Code § 19-4-701 et seq., said agency shall request a transfer of 21 appropriation from the Chief Fiscal Officer of the State, stating clearly the 22 amount required. Upon approval of the Chief Fiscal Officer of the State said 23 appropriations shall be established upon the books of the Department of 24 Finance and Administration in compliance with the applicable classifications 25 of appropriations as enumerated in Arkansas Code §§ 19 -4-521 through 19-4-26 527. 27 The provisions of this section shall be in effect only from July 1, 2024 28 2025 through June 30, 2025 2026. 29 30 SECTION 70. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 31 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FUND 32 TRANSFER AUTHORITY. From time to time, the Chief Fiscal Officer of the State 33 may transfer from his or her books and those of the Treasurer of State and 34 the Auditor of State from the Medical Marijuana Implementation and Operations 35 Fund to various state agencies' funds the amounts necessary to fund the 36 HB1202 37 01/22/2025 9:37:18 AM JAP008 expenses for the implementation, administration, and/or enforcement of the 1 Arkansas Medical Marijuana Amendment of 2016. 2 The provisions of this section shall be in effect only from July 1, 2024 3 2025 through June 30, 2025 2026. 4 5 SECTION 71. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 6 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. BLANKET 7 BOND PROGRAM. The Secretary of the Department of Finance and Administration 8 is authorized to transfer Appropriation between the Blanket Surety Bond 9 Program appropriations authorized for State Employees (Appropriation 2DM), 10 County Employees (Appropriation 2DN), Municipal Employees (Appropriation 2DP) 11 and Public School Employees (Appropriation 2DQ). 12 The provisions of this section shall be in effect only from July 1, 2024 13 2025 through June 30, 2025 2026. 14 15 SECTION 72. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 16 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. TRANSFER 17 PROCEDURES - VARIOUS TEMPORARY APPROPRIATION FOR STATE AGENCIES AND 18 INSTITUTIONS. (i) In the event that sufficient appropriation is not provided 19 by the General Assembly for any state agency or institution, an agency or 20 institution may request a transfer of appropriation, as provided in the 21 Various Temporary Appropriation for State Agencies and Institutions 22 Appropriation Section of this Act, from the Chief Fiscal Officer of the 23 State, stating clearly the amount requested, purpose and any additional 24 information requested by the Chief Fiscal Officer of the State. 25 (ii) After reviewing a request the Chief Fiscal Officer of the State may 26 deny, modify or approve the agencies or institutions request based on the 27 estimated amount of appropriation needed and currently available, purpose, 28 estimated funding available and preferred spending priority. Upon approval 29 or modification of a request by the Chief Fiscal Officer of the State and 30 after meeting the requirements of subsection (iii) herein, the Department of 31 Finance and Administration shall establish the transfer of appropriation on 32 the books of the Department of Finance and Administration and the State 33 Auditor, in compliance with the applicable classifications of appropriations 34 as enumerated in Arkansas Code 19 -4-521 through 19-4-525. 35 (iii) Any request approved as authorized in subsection (ii) herein, 36 HB1202 38 01/22/2025 9:37:18 AM JAP008 including requests that establish a new commitment item or new appropriation 1 shall require prior approval by the Arkansas Legislative Council or if 2 meeting in Regular or Fiscal Session the Joint Budget Committee. 3 (iv) Any appropriation approved as authorized in this Section shall not be 4 carried forward to the next fiscal year and shall be identified as a change 5 level increase by the state agency or institution, if requested. 6 (v) Determining the maximum amount of appropriation for a state agency or 7 institution each fiscal year is the prerogative of the General Assembly. 8 This is usually accomplished by delineating such maximums in the 9 appropriation act(s) for a state agency or institution. Further, the General 10 Assembly has determined that a state agency or institution may operate more 11 efficiently if some flexibility is provided to the state agency or 12 institution authorizing broad powers under this section. Therefore, it is 13 both necessary and appropriate that the General Assembly maintain oversight 14 by requiring prior approval of the Legislative Council or Joint Budget 15 Committee as provided by this section. The requirement of approval by the 16 Legislative Council or Joint Budget Committee is not a severable part of this 17 section. If the requirement or approval by the Legislative Council or Joint 18 Budget Committee is ruled unconstitutional by a court of competent 19 jurisdiction, this entire section is void. 20 The provisions of this section shall be in effect only from July 1, 2024 21 2025 through June 30, 2025 2026. 22 23 SECTION 73. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 24 authorized by this act shall be limited to the appropriation for such agency 25 and funds made available by law for the support of such appropriations; and 26 the restrictions of the State Procurement Law, the General Accounting and 27 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 28 Procedures and Restrictions Act, or their successors, and other fiscal 29 control laws of this State, where applicable, and regulations promulgated by 30 the Department of Finance and Administration, as authorized by law, shall be 31 strictly complied with in disbursement of said funds. 32 33 SECTION 74. LEGISLATIVE INTENT. It is the intent of the General 34 Assembly that any funds disbursed under the authority of the appropriations 35 contained in this act shall be in compliance with the stated reasons for 36 HB1202 39 01/22/2025 9:37:18 AM JAP008 which this act was adopted, as evidenced by the Agency Requests, Executive 1 Recommendations and Legislative Recommendations contained in the budget 2 manuals prepared by the Department of Finance and Administration, letters, or 3 summarized oral testimony in the official minutes of the Arkansas Legislative 4 Council or Joint Budget Committee which relate to its passage and adoption. 5 6 SECTION 75. EMERGENCY CLAUSE. It is found and determined by the 7 General Assembly, that the Constitution of the State of Arkansas prohibits 8 the appropriation of funds for more than a one (1) year period; that the 9 effectiveness of this Act on July 1, 2025 is essential to the operation of 10 the agency for which the appropriations in this Act are provided, and that in 11 the event of an extension of the legislative session, the delay in the 12 effective date of this Act beyond July 1, 2025 could work irreparable harm 13 upon the proper administration and provision of essential governmental 14 programs.
