MODULAR BUILDING FOR CODE COMPLIANCE; TO DECLARE AN 10 
EMERGENCY; AND FOR OTHER PURPOSES. 11

A MODULAR BUILDING FOR CODE COMPLIANCE; 16 
AND TO DECLARE AN EMERGENCY. 17

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19 
 20 
 SECTION 1.  Arkansas Code ยง 20 -34-101(a)(1), concerning independent 21 
inspections of modular buildings for code compliance, is amended to read as 22 
follows: 23 
 (a)(1)  A manufacturer of modular or factory -built structures, other 24 
than manufactured housing that is governed by the United States Department of 25 
Housing and Urban Development, certified to do business in the State of 26 
Arkansas may contract with an independent third -party compliance assurance or 27 
inspection agency that is listed with the International Accreditation 28 
Service, Inc., or other International Organization for Standardization and 29 
International Electrotechnical Commission ISO/IEC 17011 -compliant 30 
accreditation body, for the inspection of modular or factory -built buildings 31 
destined for delivery within the state for compliance with the Arkansas Fire 32 
Prevention Code and applicable state and municipal electrical, plumbing, and 33 
mechanical codes. 34

General Assembly of the State of Arkansas that existing laws unfairly and 1 
unreasonably restrict the number of accreditation bodies that are permitted 2 
to provide third-party certification of modular structures in this state; 3 
that allowing other qualified and accredited organizations to provide third	-4 
party certifications of these structures would be beneficial to the state and 5 
decrease costs to consumers; and that this act is immediately necessary 6 
because the economic restrictions and limited choices for manufacturers for 7 
manufactured and modular structures directly hinder the economy of this state 8 
by restricting competition, increasing costs, and adversely impacting 9 
economic activity. Therefore, an emergency is declared to exist, and this act 10 
being immediately necessary for the preservation of the public peace, health, 11 
and safety shall become effective on: 12 
 (1)  The date of its approval by the Governor; 13 
 (2)  If the bill is neither approved nor vetoed by the Governor, 14 
the expiration of the period of time during which the Governor may veto the 15 
bill; or 16 
 (3)  If the bill is vetoed by the Governor and the veto is 17 
overridden, the date the last house overrides the veto. 18
