AN ACT TO AMEND THE LAW CONCERNING THE FORM OF 9 
BALLOTS; TO AMEND THE LAW CONCERNING THE USE OF A 10 
PREFIX IN AN ELECTION FOR A NONPARTISAN JUDICIAL 11 
OFFICE BY AN APPOINTEE TO A NONPARTISAN JUDICIAL 12 
OFFICE; TO ALLOW A CANDIDATE FOR THE OFFICE OF 13 
JUSTICE OF THE SUPREME COURT OR JUDGE OF THE COURT OF 14 
APPEALS WHO IS SERVING IN THAT POSITION AS AN 15 
APPOINTEE TO USE THE TITLE OF THAT POSITION AS A 16 
PREFIX ON THE BALLOT; AND FOR OTHER PURPOSES. 17

TO ALLOW A CANDIDATE FOR THE OFFICE OF 21 
JUSTICE OF THE SUPREME COURT OR JUDGE OF 22 
THE COURT OF APPEALS WHO IS SERVING IN 23 
THAT POSITION AS AN APPOINTEE TO USE THE 24 
TITLE OF THAT POSITION AS A PREFIX ON 25 
THE BALLOT. 26

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 28 
 29 
 SECTION 1.  Arkansas Code ยง 7 -7-305(c)(1)(B), concerning the form of 30 
ballots and the use of a prefix to the name of a person who files for an 31 
elective office, is amended to read as follows: 32 
 (B)  A person may use as the prefix the title of a 33 
nonpartisan judicial office in an election for a nonpartisan judicial office 34 
only if: 35 
 (i)  The person is currently serving in a nonpartisan 36    	HB1223

judicial office to which the person has been elected in the last election for 1 
the office; or 2 
 (ii)  The person: 3 
 (a)  Is a candidate for the office of Justice 4 
of the Supreme Court, Judge of the Court of Appeals, circuit judge, or 5 
district judge; 6 
 (b)  Is currently serving in the office of 7 
Justice of the Supreme Court, Judge of the Court of Appeals, circuit judge, 8 
or district judge as an appointee; and 9 
 (c)  Has been serving in that position for at 10 
least twelve (12) months. 11
