SECTION 13. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 26

GENERALS SALARY. The line item maximums for the State of Arkansas Adjutant 28
General and Deputy Adjutant General are based on the salary grid by the 29
United States Department of Defense. Incumbents in these positions shall be 30
compensated in accordance with the Department of Defense Advisory Service Pay 31
Plan and are not guaranteed placement at the maximum level. The line item 32
maximum salaries may be adjusted on July 1 of each fiscal year to incorporate 33
salary rate changes that have been implemented by the U.S. Department of 34
Defense. 35
The provisions of this section shall be in effect only from July 1, 2024 36 HB1232

SECTION 14. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 3
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 4
PROMOTIONAL ITEMS. The State Military Department is hereby authorized to 5
transfer appropriation from Operating Expenses to Promotional Items in the 6
General Operations Appropriation and/or Cash Operations Appropriation 7
provided by this Act in an amount not to exceed ten thousand dollars 8
($10,000) each fiscal year, as authorized by the Director of State Resources, 9
and with the approval of the Chief Fiscal Officer of the State. 10
The provisions of this section shall be in effect only from July 1, 2024 11
2025 through June 30, 2025 2026. 12

SECTION 15. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 14
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 15
CARRY FORWARD OF FUNDS. 16
(a) The Chief Fiscal Officer of the State shall cause to be transferred 17
on his or her books and those of the State Treasurer and Auditor of State the 18
balance of funds remaining in the Department of Military Fund Account on June 19
30, 2025 2026 into a sub-fund created within the Department of Military Fund 20
to be used exclusively for construction, maintenance and operating expenses 21
or for future construction projects of the State Military Department. 22
(b) Any carry forward of unexpended balance of funding as authorized 23
herein, may be carried forward under the following conditions: 24
(1) The Office of Budget of the Department of Finance and 25
Administration shall report to the Legislative Council all amounts carried 26
forward by the September meeting of the Legislative Council or the Joint 27
Budget Committee meeting which report shall include the name of the agency, 28
board, commission, or institution and the amount of funding carried forward, 29
the program name or line item and the funding source; and 30
(2) The State Military Department shall provide a written report 31
to the Legislative Council or Joint Budget Committee containing all 32
information set forth in subdivision (b)(1) of this section no later than 33
thirty (30) days prior to the time the Department presents its budget request 34
to the Legislative Council or Joint Budget Committee, or both; and 35
(3) Thereupon, the Department of Finance and Administration shall 36 HB1232

include all information obtained in subdivision (b)(2) of this section in the 1
budget manuals. 2
The provisions of this section shall be in effect only from July 3
1, 2024 2025 through June 30, 2025 2026. 4

SECTION 16. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 6
authorized by this act shall be limited to the appropriation for such agency 7
and funds made available by law for the support of such appropriations; and 8
the restrictions of the State Procurement Law, the General Accounting and 9
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 10
Procedures and Restrictions Act, or their successors, and other fiscal 11
control laws of this State, where applicable, and regulations promulgated by 12
the Department of Finance and Administration, as authorized by law, shall be 13
strictly complied with in disbursement of said funds. 14

SECTION 17. LEGISLATIVE INTENT. It is the intent of the General 16
Assembly that any funds disbursed under the authority of the appropriations 17
contained in this act shall be in compliance with the stated reasons for 18
which this act was adopted, as evidenced by the Agency Requests, Executive 19
Recommendations and Legislative Recommendations contained in the budget 20
manuals prepared by the Department of Finance and Administration, letters, or 21
summarized oral testimony in the official minutes of the Arkansas Legislative 22
Council or Joint Budget Committee which relate to its passage and adoption. 23

SECTION 18. EMERGENCY CLAUSE. It is found and determined by the 25
General Assembly, that the Constitution of the State of Arkansas prohibits 26
the appropriation of funds for more than a one (1) year period; that the 27
effectiveness of this Act on July 1, 2025 is essential to the operation of 28
the agency for which the appropriations in this Act are provided, and that in 29
the event of an extension of the legislative session, the delay in the 30
effective date of this Act beyond July 1, 2025 could work irreparable harm 31
upon the proper administration and provision of essential governmental 32
programs. Therefore, an emergency is hereby declared to exist and this Act 33
being necessary for the immediate preservation of the public peace, health 34
and safety shall be in full force and effect from and after July 1, 2025. 35
