The State Military Department is hereby authorized to 9 transfer appropriation from Operating Expenses to Promotional Items in the 10 General Operations Appropriation and/or Cash Operations Appropriation 11 provided by this Act in an amount not to exceed ten thousand dollars 12 ($10,000) each fiscal year, as authorized by the Director of State Resources, 13 and with the approval of the Chief Fiscal Officer of the State. 14 The provisions of this section shall be in effect only from July 1, 2024 15 2025 through June 30, 2025 2026. 16 17 SECTION 15. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 18 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. 19 CARRY FORWARD OF FUNDS. 20 (a) The Chief Fiscal Officer of the State shall cause to be transferred 21 on his or her books and those of the State Treasurer and Auditor of State the 22 balance of funds remaining in the Department of Military Fund Account on June 23 30, 2025 2026 into a sub-fund created within the Department of Military Fund 24 to be used exclusively for construction, maintenance and operating expenses 25 or for future construction projects of the State Military Department. 26 (b) Any carry forward of unexpended balance of funding as authorized 27 herein, may be carried forward under the following conditions: 28 (1) The Office of Budget of the Department of Finance and 29 Administration shall report to the Legislative Council all amounts carried 30 forward by the September meeting of the Legislative Council or the Joint 31 Budget Committee meeting which report shall include the name of the agency, 32 board, commission, or institution and the amount of funding carried forward, 33 the program name or line item and the funding source; and 34 (2) The State Military Department shall provide a written report 35 to the Legislative Council or Joint Budget Committee containing all 36 As Engrossed: H3/18/25 HB1232 11 03-18-2025 17:24:02 BSS013 information set forth in subdivision (b)(1) of this section no later than 1 thirty (30) days prior to the time the Department presents its budget request 2 to the Legislative Council or Joint Budget Committee, or both; and 3 (3) Thereupon, the Department of Finance and Administration shall 4 include all information obtained in subdivision (b)(2) of this section in the 5 budget manuals. 6 The provisions of this section shall be in effect only from July 7 1, 2024 2025 through June 30, 2025 2026. 8 9 SECTION 16. Disbursement of funds 10 authorized by this act shall be limited to the appropriation for such agency 11 and funds made available by law for the support of such appropriations; and 12 the restrictions of the State Procurement Law, the General Accounting and 13 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 14 Procedures and Restrictions Act, or their successors, and other fiscal 15 control laws of this State, where applicable, and regulations promulgated by 16 the Department of Finance and Administration, as authorized by law, shall be 17 strictly complied with in disbursement of said funds. 18 19 SECTION 17. LEGISLATIVE INTENT. It is the intent of the General 20 Assembly that any funds disbursed under the authority of the appropriations 21 contained in this act shall be in compliance with the stated reasons for 22 which this act was adopted, as evidenced by the Agency Requests, Executive 23 Recommendations and Legislative Recommendations contained in the budget 24 manuals prepared by the Department of Finance and Administration, letters, or 25 summarized oral testimony in the official minutes of the Arkansas Legislative 26 Council or Joint Budget Committee which relate to its passage and adoption. 27 28 SECTION 18. EMERGENCY CLAUSE. It is found and determined by the 29 General Assembly, that the Constitution of the State of Arkansas prohibits 30 the appropriation of funds for more than a one (1) year period; that the 31 effectiveness of this Act on July 1, 2025 is essential to the operation of 32 the agency for which the appropriations in this Act are provided, and that in 33 the event of an extension of the legislative session, the delay in the 34 effective date of this Act beyond July 1, 2025 could work irreparable harm 35 upon the proper administration and provision of essential governmental 36 As Engrossed: H3/18/25 HB1232 12 03-18-2025 17:24:02 BSS013 programs.
