AN ACT TO AMEND THE ARKANSAS EGG MARKETING ACT OF 9 
1969; TO AUTHORIZE REPACKAGING OF EGGS BY A RETAILER 10 
IF CERTAIN CRITERIA IS MET; AND FOR OTHER PURPOSES. 11

OF 1969; AND TO AUTHORIZE REPACKAGING OF 16 
EGGS BY A RETAILER IF CERTAIN CRITERIA 17 
IS MET. 18

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20 
 21 
 SECTION 1.  Arkansas Code ยง 20 -58-207(e), concerning prohibited acts 22 
under the Arkansas Egg Marketing Act of 1969, is amended to read as follows: 23 
 (e)(1)  Except as provided in subdivision (e)(2) of this section, eggs 24 
Eggs in retail shall not be removed from the immediate container in which the 25 
eggs were received and placed into a different container by the retailer. 26 
 (2)  Eggs in retail may be removed from the immediate container 27 
in which the eggs were received and placed into a different container by the 28 
retailer if: 29 
 (A)  Eggs used to replace missing or broken eggs: 30 
 (i)  Are of the same packer, as evidenced by the 31 
license number printed or stamped on the carton or container; 32 
 (ii)  Are of the same grade and size, as evidenced by 33 
the label on the carton or container; 34 
 (iii)  Have the same expiration date, lot code, or 35 
Julian date, as evidenced by the label or stamp on the carton or container; 36    	HB1279

 (iv)  Are from the same brand, as evidenced by the 1 
label; and 2 
 (v)  Are visibly clean with no prominent stains, 3 
adhering dirt, debris, fecal matter, or other foreign material; 4 
 (B)  Eggs adjacent to eggs that have leaked into the carton 5 
or container and are in contact with the spilled egg content shall not be 6 
used as replacement eggs; 7 
 (C)  All repackaging and consolidation activities take 8 
place on clean, sanitized surfaces using safe and appropriate food 9 
preparation practices; and 10 
 (D)  The retailer has a written procedure for egg 11 
replacement of missing or broken eggs to train employees on the requirements 12 
of this section. 13
